just is a suggestion can help us track the trend of 3 options
Every one who got 3 options from dol can you please let us know how many ads were placed before filling labour certification
Like in my case
3 ads(approximately it took 7 months)
Job posting in company for 2 weeks
Companys website.
It was finally submitted in RIR EB3 Category.
Degree MS in IS in US.
this is help us in evaluating what is going on.

Tracking the NOFs and Remand-To-State
The following are the crucial information, in my opinion, needed to track NOFs and Remand To States.
1. Min Job Requirement specified in the Application
2. DOT code or Job Title
3. Company's Business Domain
4. Time left in your 6 year H1 period
5. Layoff or Hiring trend in your company in the past one year

I have been a silent reader of this forum for
a very long time(around 7 mths) and I must
say that this forum is very useful.
If I remember correctly, Mr Rajiv Khanna
was going to send a petition. Whatever
happened to it.
I wonder what really goes on at the DOL?
If we haven't been laid off till now then does
that not mean that we are an asset to our
company? How can anyone be so dim-witted.

NOF Letter Reply
Hi,
I just spoke with my attorney about the Reply to the 3 Option NOF letter. She told me that the employer ran an advertisement for 2 weeks and at the end of 2 weeks the attorney will compose a letter stating the number of resume recieved and that they dont qualify.
She told me that reply doesn't need to attach the resume recieved or any details of interview, so basically they just give
their word to DOL. So how many resumes recieved and interviews conducted doesn't have any affect.
Anybody with more knowledge can verify if this is true?

Did any one of you have a DOT code of 030.062-010(Software engineer). What is the approval rate for this DOT code.
In our company one case got approved with DOT 999.151-032 on 06/03/03 and all the other DOT codes such as(031 and 041) got remanaded back to state . For my LCA DOL is niether approving nor remanding back to state. They are issuing NOFs(asking for info) for my case for the past one year.
BTW: Priority date of my case (01/02/02 in DOL).

Remand to state means that your case is transfered back to the State level (SWA or SESA or EDD) to process the case as
Regular Labor certification and not RIR
NOF is notice of finding, this can be anything that DOL would like more information on, the NOF with 3 option letter has given 3 choices of either Withdraw, send back to State (Remand to State), and lastly to run one more advertisement and wait for 2 weeks and submit the response that you were unable to find US worker thus grant the RIR.
