H1 Revalidation (SL August 28th) and I-94 Issues
Sorry..I think I pressed the wrong button without completing my previous comments.
Starting all over again..it will take some time to read my points. please bear that and help me.
I have sent my papers for revalidation on Aug 27th and
SL date is Aug 28th.
Need to find the DC received date.
Checks were cashed on September 10th.
You guys know where the checks will be cahsed? Once the app reaches DC or in SL itself?
Leaving that issue aside, I have to explain something here. This is going to be a long one, please bear with me.
I was working for company A from Feb 2001 till July 2003. I got the visa stamped against that company A in my passport and that was valid up to Sep 2003. I visited India in June 2002 and came back from India in July 2002 (on Company "A"'s visa).
While entering, the Customs Officer stamped the I-94 till March 23, 2003 which matches with my passport expiry date. In Feb 2003, I applied for a new passport and received a new one in the same month which is valid till 2013. [Now, I have an old passport in which my visa was stamped till Sep 2003 and the new one with no stamping].
Even though I had my I-94's date as March 23rd 2003, I got an amended H1 from Company "A" which has an I-94 which was valid till Sep 2003. According to that, I think that I was not out of status. Right? Now, I have two I-94s.
One which has a date till
March 23rd 2003, I call this "I94-A" and
Sep 2003 and I call this "I94-B".
Recently in July 2003, I have switched jobs and got a new H1, {and the H1 has a sentence saying that my [I-94A]'s expiry date has been noted wrong by the customs officer} ofcourse along with new I-94 and I call this
"I94-L" which is valid till Apr 23 2006.
While sending the documents for stamping I did not send neither Original "I94-B" from my amended H1 from Company "A" nor Original "I-94L" that came with my latest H1, which I realized is a problem later and was the dumbest thing that one can do ever. I cursed myself many times which did not help me though.
Instead I have sent a photocopy of the latest "I-797" and "I-94L". But, my old passport has the "I94-A" stapled to it.
Now, tell me what you think:
1. Whether my new passport gets stamped against the latest H1?
2. Was or Is it a problem if we did not extend the I-94 that had a date which was equivalent to my old passport's expiry date even though I had an I-94 that bore a date which is equal to my visa expiry date from Company "A"? Was I out of status anytime?
3. Now, having a new H1 and new I-94 which is valid till Apr 2006, would that be considered as the latest and the stamping will be done?
4. Or, the documents will be sent back asking for original I-94 since that was missing?
5. If they cahsed the checks that means the scrutiny is done and the papers are ok?
And also, if they send me the documents asking for the original I-94, should I send all three I-94s or only the latest one or "I-94A" and "I-94L"?
