You are talking as if the DOL Atlanta looks at each case, and check whose H1 is near expiry and then decides to certify those petitions.
My friend that is not the case. They use papers and Electronic methods (Database + Applications). So there is no way there are able to track those people.
If you were having an eye on the immigration news, you would have heard that just 2 days back they released the manual for the electronic entry. I read that and they were talking about the data entry part and process of the proposed application for LC.
DOL is currently understaffed, underfunded and the top of that security alerts and unemployment rates have paralysed the petitions approvals.
My best guess is that they pick up the case that are very top of their table, and process few, and then the next day they get new applications piled on the top of them. Our cases happened to be at the bottom of the rack, and they hopefully would get to it when their table cracks and it cannot handle more petitions on the tables any more. Just joking !!!
Most of us would get certified, because if you have read the details of the Memo send to the DOL people, suggesting to approve cases with Bachelors + 3 yrs or, Master + 5 months job requirement. When is the only question we all have in our mind.
I agree with NI that there is no point in worrying, but at the same there is so much frustation. We are working with a system resembling the government officials in india.
