I spoke with my attorney, he said according to the law or rule, they should give RIR higher priority. But if you talk to DOL office, they will say " yeah, we know, but if we don't process NON-RIR at the same time, those cases will never have chance to get processed because of two many RIR".


If you can , let your attorney talk to Mr. Goodman directly, he is in charge. Anybody else is just workers.

According to your lawyer Atlanta is processing Sep'02 cases,
But If you will see this site ( Immigration.com as they recently
updated the site ), you will find that Atlanta is still processing
Aug'02 Cases; And Still in this Thread we have couple of people
whose Labor date at Atlanta is Aug'02 and they are still waiting.

I hope as soon as these guys hear some Good news from their lawyer they will Update this forum and the Excel sheet.

Everybody please try to call this Guy at Atlanta office and let him know the problem we are facing with the current processing speed OR have your lawyer called this guy....But I can't expect anything from these lawyers as they can't understand our situation and would never make a call..
 
I think they are working on sep cases and some pending aug cases too.

In any case, there are tons of applications ahead.

Unless some miracle happens, there is no way they're going to clear within a year.

I doubt the benefit of calling Mr. Goodman. I am sure he is aware of the situation. We all know how inefficient the atl DOL center is. I have been waiting for more than 2 years with RIR. But calling him is not going to reduce the case load, is not going to get additional funding to hire more people and is not going to change the way they process.

I don't think it is on first come first serve basis, because we all know that some cases were approved within several weeks. I thought those are 245(i) cases. There must be some sub-process of prioritizing cases.

I don't see anything will help EXCEPT continuing waiting. I am glad the BCIS relaxed the rule of 7th year H1B, because mine is running out of 6-year limit.

I feel so dreadful thinking ahead of the prolonged wait time even ahead with Texas 140/485. Shelley writes, "When Winter is here, will Spring be far behind?" In this GC crusade, I don't know when the Spring will come?
 
Like the petitions on the main page of this site, can we all come up with a representation to the Director, Atl DOL and sign it and send to him?
 
My case has RD of 26 August, 2002 in Atlanta Region DOL. I just called AVM and it is still at "has been received in regional office".
How come they process cases from September when August is pending. Totally disgusting.
 
I call AVM this morning. I just can not believe that my case was certified.

My case was received with the same DOT code on Feb6'2003,
I am happy for you, but it is soo frustrating to even imagine
how they are processing the cases.

I call the AVM it says the status was posted on Feb '6 2003,
does this mean the status is out of date and has not been updated????

My case has the same DOT code 030.162-014. Title is Programmer/Analyst. What is going on? August 2002 cases are pending and 2003 last month case gets approved. something messy and mysterious is going on.

I don't think so.
The only special thing is we use a very special programming language for the project. It¡¯s very hard to find the person who has some experience in this language, and also the project that I ¡®m working is relate to high education. I do not know if my company or my attorney did some special for my case.

Hi.
I am a consultant whose I140 is underway at the CSC. I have got a nice job offer in Florida. Could anyone give me the appx timings of Labor processing in Florida. I am getting confused on whether i should leave my GC and start afresh in Florida.

FL Labor eventually moves to Atlanta (regional DOL) and it is not that great. And, I think FL-SESA is typically taking 4 months (they are on 03/14 according to SESA web site).

I would think twice abondoning the process in I140 stage esp. if you filed concurrently! How long have you filed 140/485 now..? If you are close enough, see if your new Co. can take on a contract to hire basis for the remaining duration to be able to use AC21! Eventually it also saves your new Co. some money though you can always start processing your GC even while you are on contract-to-hire basis.
 
Hey Guys,

Questions on the above 2 messages.

1) How does it work if one joins a job in Florida (BCIS, texas) while his/her GC is in 140/485 stage in California BCIS? Will the case be tranfered to BCIS, TX?

2) If yes, how will it be processed as per BCIS, California RD/priority dates or as per BCIS, TX center dates?

3) What about the risk of moving to state/location other than what was given for labor certification?

Please clarfiy.
