Raj was saying, he will not go for CP because of lengthy processing time for 140 approval. Rather he can file 140/485 together and get EAD for him and his wife.

RFE on my friend's application.

My Friend just found out via his attorney, that DOL has issued a RFE for insufficient Advertisement.

His Rec. Date is Nov 19th,
Title: ERP Analyst/Programer
State: Florida.

It sucks after 2 years of wait, His company needs to re-advertise for month & half (in one paper media & on one web-site), screens the applications, conduct recruitment afforts & provide logical explanations for rejecting all applicants and submit all info to ATL DOL.

His HR is currently "tightlips" and not in a hurry to pursue aggresive recruitment efforts immediately. He is worried that he might get laid off due to this hassel and extra expenses (legal & admistrative).

Is there anything he can do to expedite the process? Does any of you know anybody who dealth with similar situation?

I really feel sorry for him and want to help him.

I feel sorry for your friend too.

One thing he can do is, take care of all the expenses for the new advertisements.

1. Did your firend place any add b4 submitting Labor application? If so how many and which media?

2. Was that RIR? I hope so...

3. Please let us know the case umebr (if you want to share). I am asking coz there was one case 04394500 was pending from Nov. Is that your firends?

I agree with TAMIL_GC, that is the only option and company would be agree happily with that.

Expenses

If i were him, i would take care all the expenses including all the hassels in advertisement process. Though this idea might not work 100%. Good luck for him .

Problem is Big Five consulting

He works for one of the big Five consulting firm in US.

Of course, they always have ad running in News Paper and on Internet 365 days.

The case is EB2/RIR

He himself does not know the case number. By putting employer's phone number won't work since his company has more than 500 LC applications pending and his company has around 80 different offices through out US so he doesn't know which phone number to use.

His attorney won't talk much to him directly & His HR doesn't care much. Luckily, he is on project so he is surviving otherwise, he thinks that he is just a number (not a human) for the company.

Paying for the ads, etc. won't work for him since it's not written in HR policy & procedures. And also, he has to run by companies policies (not changing attorney, etc.)

He is trying to expedite the process via his immediate Manager and his home office Partner (or you can say Director).

My case number is something like GA 999999 ( GA followed by 6 digits). Did you recieve the 13-digit application reciept number from GE DOL?

To all,

I talked to a frined of mine regarding his GC Labor application. His Labor sent to ATL DOL on Jan 16th 2003 and his Labor approved in 3rd week of July 2003. How can this is possible? This is affirmative information (and not speculation) and he filed for I-140/I-485/EAD and got the EAD already 3 months ago.
 
That's not your correct case number

Generally, case number is only digits like

04391792.

It shouldn't have GA or FL in front of it.

Pin hurts more than Pain and I am already hurt by this damm DOL...don't push more pins to me...lol

The case number which you have is from Georgia SESA (State DOL). Its not the regional case number. Regional case number would be genreally 8 digits starts with 0.

Your friend LC approval is not surprise for ATL DOL filers. Thats way the ATL DOL works. You can never predict the way they work.

Same thing happened to me , when my company showed the
right docs they certified it, My thought is if his company advertised
the Job properly they just have to produce the documents to show it ... it should be fine

The only problem is that his company uses too generic job description for the job openings....and that's where he thinks his attorney (paralegal) screw up...

He had a feeling from the beginning that the job description in the advertisement was generic compared to his skills and work experience, etc..... Anyway, he never dealt with Attorney..attorney and always talked with paralegals....His company's law firm is Berry Apple....and, now the attorney is looking into the matter...Hopefully, he/she should be able to apply some pressure due to big law firm and thing will work out for him....
 
Its frustrating

My First morning call at work would be to check my status. I was curious to know what ATLDOL is doing ... Just gave some random case numbers here are the results

Case 04406585/Rcvd on Aug 11th 2003 Certf on Aug 23rd 2003
Case 04407589/Rcv Aug 14th Certf on OCt 30th 2003...

One of them is the IT related case... I don't know why Atl dol is doing this kind of processing.. leaving people who are in the line and processinf the ones that are new.... I saw this happenninglike this in Aug/Sept of Last yr where they approved most of the May cases.. I thought it would beo ne of mine.. but to my Bad luck.. its not....

Just wanted to let u guys know

AVM's received date is not actual DOL received date. One of friend was telling me that his case was forwared on Feb'2003 from Georgia SESA. After loooong period his case showed up in AVM. But it says received date as Oct'2003. He is still waiting for his approval.

My application is received by ATL DOL on Feb 06 2003.

My case number (Georiga SESA office reciept #) is GA 016531.
I do not know my ATL DOL case number.
It is very hard for me get that information from my attorney .

Can one of you give me your case number please. So that I know what my case number will be (in and around same).

Here are some of the case no's registered at DOL and their dates:

04392000 - aug 27' 02
04393000 - sep 25' 02
04394000 - oct 07' 02
04395500 - dec 03' 02
04396000 - dec 23' 02
04397000 - jan 13' 03
04398000 - feb 06' 03
04399000 - feb 18' 03
04400000 - mar 10' 03
04401000 - apr 09' 03
04402000 - apr 14' 03
04402500 - may 23' 03

Average filing rate looks like 1000 cases per month and processing is more or less the same in 2002.

In 2003 between jan - april, more than 6000 cases were filed which means it's going to be very slow to move from each date.
 
thanks Sunny_sm. I called my employer and found out my case number. That falls into the numbers you listed. (Feb-6-2003 - 04398000)

And then I talked to 3 more guys (friends of my friend) and their applications were received by ATL DOL on 2/18/2003, 3/14/2003, 3/24/2003 were already approved around June 1st week, Aug 3rd week 2003 respectively.

Unanswered question : How come the applications at later dates were processed earlier?

I called 404-562-2131.

Is there a website to get same information?
