My RIR case was forwarded to Atlanta Regional on July 23rd, but I don't get the case number till now, almost 3.5 month.

But my lawyer assistant ask me donot worry, he is just trying to make a phone call to the regional office.

Do I have to ask the lawyer to call the Atlanta office?

Case Numbers - an Unsolved mystery

ATL DOL is currently assigning case numbers for september cases. Basically, there is a one month delay in the assignment of case numbers. If your lawyer sends a fax to them 2+ months after the case is transferred to Atlanta, they will probably respond with the case number. I am waiting for my case number as well. My application moved to ATL DOL mid september.

Regarding some other posts that were made earlier, FL SESA sends out a letter once they finish processing the file at the state level. This letter would contain the case number assined by SESA. After the SESA stage, the application goes to Atlanta. Atlanta DOL assigns case numbers(this is different from the case number assigned at the state level) to the applicaiton, but does not automatically send any letters or confirmation to the lawyer. The lawyer has to send a fax to ATL DOL to request for the case number. Once ATL DOL receives the request they will send out the information to the lawyer.
 
Seems like, officers at ATL DOL are already into "Holiday mood".

Well, all we can do is hope for the best.

There is a saying: "Slow and steady wins the race". I pray to god that it becomes applicable to all of us who have been suffering for so long.

I think everything is best at ATL DOL. Well now AVM is down. This remains down every monday morning and adding more frsutation to existing condition.
 
Check every week

I would say to everyone that please check your case number every week on the AVM (if it works :rolleyes:) . No one know when a particular case will get certified.

I hope that Atlanta DOL shouldn't go into "Holiday Mood" this early. It's been a while since we have heard an approved labor... C'mon guys keep this thread updated...

I request to those whose labor got certified / have info and are silent browser of this thread to come forward and update the website which have given then so much. It just takes a minute to create your id and you are set.
 
Just checked AVM and it is working now. All Nov case holders, please check your case through AVM and update forum with status.

Information @ change corporation.

Hey Gurus,

My Case is in Atl. Federal From NC-SESA 13th FEB-2003.
In May 2003 - Business Under Corporation "A" which filed is sold out.
New corporation "B" bought It ( Same Business ).

If Corporation " B" is ready to continue my case under his corporation will that help my case or Any other way will my case survive.

Please give me some information abour this.

Should not be a problem. The H1 as well as the Labor/GC will be transferred to the new company. As long as the new company is willing to continue your petition, you will be fine.

If you are on a H1, an *ammendment* shoule be filed by the new company so that the H1 is under the new company name. There is no time limit for filing the H1 amendment.

Is there a possibility to switch to vermont center for
140 and 485 instead of waiting for another 3yrs in Texas?

I work in NJ and my company division is in Tennesse.
I am already in 7yr of my H1.

How about Consular Processing during H1 7th yr?

Any thoughts?

When you get answer to your questions, will you please let me know? I am also in the same boat, but my case was forwarded to ATL DOL from Georgia state on March 10, 2003.

I do not think it is possible to move your case to Vermont. Basically, the department where you will be working is in TN and the labor is approved for TN. All cases from TN go to Texas and there is no way of avoiding TX. If you file a new labor from a different branch in a state that goes to Vermont, then you have a chance.

In any case, since the 180 day rule will apply to your petition, 180 days into the 485 stage you can switch employers.
 
Every day count for us but apparently Atlanta DOL couldn't care less. Only thing which we can do is wait, frustating............:mad:
