Sorry, it was 02/19/03.

I talked to my lawyer, and she said she've seen it before and it is DOL's mistake. she said she will file the response to dol, and full processing takes about 1 month!!! can you believe it? it is not my fault, but dol's. and I am the one who get penalty for it. :(

AVM Sucks....

Hear this guys....

I just talked to a friend of mine whose labor was approved back in Dec 03.....AVM still says case has been received.....

I feel like slapping DOL people when they ask us to check AVM when we call in person.....

Can i convert my Labor from Non-RIR to RIR ??

I am in the 7th year of H1 and in Atlanta the Non-RIR labor is dated back to April 2001. Mine is filed under Non-RIR.

I have few questions..

1. Can i convert my Labor from Non-RIR to RIR... If so how?
2. Can i change my lawyer while DOL is processing my Labor?
3. Can i keep my current Labor going on and also file for Labor with the same company but under RIR through a different Lawyer?

Thanx

AVM is not tied up with flcdatacenter

I know they're not tied up with each other becuase I couldn't find my case in flcdatacenter.com, however AVM has that info. As we know flcdatacenter is most likely to be updated annually, I guess AVM is updated semi-annually, if not worse.

My company received mail from DOL, saying that my LC might be denied because of prevailing wage.
It says my salary 67k is significantly lower than prevailing wage rate which is 106k. I filed as a programmer/analyst.
It also, ask to send some more information to DOL for this issue.

Is this possible? I don't get it. my prevailing wage is not that much. right? what should I do? any experience with this issue?

Thanks

This has happened to one of my colleagues as well. His case was fwded to ATL in September 03 (GA SESA - June 03). He is waiting for the resolution, not sure if attorneys have responded yet. Usually its the DOL personnel's misunderstanding of the position or job type. You should be fine once they get clarification from your attornyes, except for the time lost in the process.

Hello shibujoys,

I suggest you consult a attorney with the questions you have.
There are some good immigration lawyers in Atlanta area. They usually charge around 100$ for initial consultation fee.

Check Khabar and Little India magazines around Atlanta area, I am sure you will find ads., from immigration attorneys. Some offer free phone consultation too.

Just thought useful...

Hello gcatlanta2004 ,

I rather prefer the text format. Its easy to open, light weight
and actually more clear. Excel has a lot of good features but
its an over kill for what we are tyring to look for in a doc.

Text format is better

Text format is better for our purpose......There may be guys who don't have Office products on their PC....

lets keep text file only

hello everyone,

thanks for the feedback. I agree to much of overhead with excel. lets keep it simple.

Does the state from which your labor went to DOL matter in processing speed.

status list

Here is the reformatted status list in txt form. Also, Paincard's record was missing in the excel file. Let's keep it simple in text format.

Hi Amoogye,

If your case was filed in the year 2001 at Georgia Department of Labor the Prevailing Wage during that period is only $57,450.Your Salary is over and above 57.450.There is nothing to worry in your case.Ask your attorney to obtain Prevailing Wage for COMPUTER SYSTEM ANALYST(Programmer Analyst) from Georgia Department of Labor and file it along with written reply.

It happend in number of cases. It's only an ERROR.If it is the only NOF, It doesn't take 1 month to process your case. You need to speedup things with your Attorney.

This problem arose in one case where we handled it without any problem.

BEST OF LUCK

shibujoys

It is the way Georgia Department of Labor Suggested in all the cases. They sent a written communication to all Attorney's in that aspect with a request to convert all Non RIR cases into RIR Cases.

It is easy to convert your case.

Best of Luck

Tamil_GC,

I am checking with my lawyer every week and I am getting the same answer:

"When we get information for all your questions we will let you know".

Re: Amoogye
