Guys, I have a question. My labor moved to Federal on April 23 and I am expecting it to be cleared in another 3 months time. Meantime my wife who is currently on H4, got an offer for job and they are filing H1, but her H1 will not get approved till atleast Nov94. If my labor gets approved before that, can I file 140/485 when her H1 is still pending or I should wait till her H1 is approved. Any idea guys. I dont want to loose any time for filing 140/485 because her H1 is pending.

iam not sure if you can get correct answer from this thread for your question. But anyways....my company had the same situation on using substitute labor for my co worker and he got his payroll processed from different state where he got his labor substitue but continued to work in different state...

imlab, hang on there. Getting a NOF is better than nothing. At least now you know they're processing your case. You'll get yours soon.

hi everyone waiting for the DOL clearance,
Can anyone tell if the DOL is still processing the April - 2001 State applications or is it done with them? Do you guys find any improvement in the processing times recently??
Your information will be very helpful for my decision making.

Guys,

Whoever is updating the list can put my info or let me know and I will update the list. My GA labor was forwarded to ATLANTA DOL on Dec 12, 2003. Have no idea if it was entered in the system or not.

I have couple of questions about the ATL regional office. Can I go to the office and try to get some information, which department(name) processes the labor certifications and which floor are they on?

I have updated the list with your case information. I don't think you can visit the office and get information about your case because LC is for your company and not yours.

ATL DOL is processing cases with forwarded date to them. So you can only find the proceesing time by forwarded date, not with state applications.
 
My labor was filed to atlanta DOL on 2/19/04

My company received mail from DOL, saying that my LC might be denied because of prevailing wage.
It says my salary 67k is significantly lower than prevailing wage rate which is 106k. I filed as a programmer/analyst.
It also, ask to send some more information to DOL for this issue.

Is this possible? I don't get it. my prevailing wage is not that much. right? what should I do? any experience with this issue?

that just might be what your neighbour in the next cubicle is harvesting -

we typically tend to undersell ourselves and this has been taken advantage of by the whole H1, L1 circus here.

ever wondered why at all companies would even bother otherwise to spend all these monies on lawyers, go thru' legal wrangles and HR heartache??

this is a 25K to 30K per year difference - for an employee from overseas who lives, breathes and practically embraces his job here.
