As you mentioned above,Is there a advanatge filing semi-concurrent(get 140's receipt first, then file 485) over concurrent?
 
As some of you may have read elsewhere, CSC has started a pilot program for adjudicating 140/485 within 90 days. One of the requirements for eligible applications is "truly concurrent" filing. So far I have not seen any explanation of "true concurrency". One possiblity is the exclusion of cases where I485 is filed after I140 receipt.

If these pilots spread across the country, this matter will be important to all of us. I suggest everyone should press their attorneys to find the correct interpretation of this phrase. NII, may be you can talk to your attorneys about it and inform the rest of us.

Mickey_32, can you find the any article related to this pilot program? I guess I want to talk to my attoney about this, but it will be very hard to ask something without fully understanding about what is pilot program first.

I might be wrong but, isn't this pilot program applicable only to Family Based GC applicants?

Also, it is not sure how long will it take them to evaluate the results of this pilot program and then implement it at other centers.

Following are the pros/cons of filing 140/485 concurrently:

  1. PROS:
  2. You get your EAD within 3-4 months after filing
  3. Once you get your AP documents you don't have to get your H1 renewed and stamped in passport everytime.
    CONS:
  4. Once your 140 is approved, you might get stuck with the same company till you get your 485 approved.

    On the other hand if you opt for CP then, once your 140 is approved, it takes about 3-6 months to get your interview call from the US Consulate from your country. You go there, appear for the interview and get you GC at the port of entry, here in US.

    In concurrent filing, it may take anywhere between 3-5 years to get your GC (given current proc. time and backlog), if you file 140/485 today.

    Whereas, if you go for CP, it may take 1.5-2 years to get the GC.

    Now things might change and situation may improve with concurrent filing over next few months/years, but tell me what is the probability of that happening?

    This all is my conclusion of the discussions that I have had with my attorney and some of my friends who have gone for CP rather then concurrent filing.

I think this issue was discussed previously in this thread. I may be wrong, but if I can recall, filing concurrently would mean that you would be interviewed here, instead of having to go through the process of being interviewed in the country of your origin. I believe someone stated that there was some expected delay prior to the interview with the concurrent filing process. (Hey, after going through the LCA process, what else is new?) Someone mentioned previously that if you file separately, the waiting time will be shorter and that the person's acquaintance then had a good experience being interviewed in his country of origin. Sorry, this is just my recollection and I could be wrong.

In my case, the choice is based upon my own personal situation. I have growing children who has grown up here all their lifes and doing extremely well, and a spouse who has been too long out of the workforce. Hopefully, this will enable us to get on with our lifes without having to worry about my children starting over in a country alien to them. Cheers!

re: family based GC, you are confusng the Dallas pilot with CSC pilot, and there is no requirement on other service centers to wait for one pilot to be over before they can initiate theirs. Also, all the advantages of concurrent filing you mentioned are equally available to apps filed together or 485 filed after 140 receipt. My discussion was about the difference between the above two approaches in the CSC pilot type situation, not AOS Vs CP. The AOS/CP issue has been discussed already in this forum.

Hope it clears the confusion.

NII, I didn't follow your latest post, no matter what sequence you file your 485 in, you are adjusting your status in the United States, and you won't be interviewed at your country's consulate. If you go for CP, you don't file fo AOS.

Hi, my LC was certified on March 22, 2004. It was received in Regional Office on Jan 23, 2003. My position is Construction Estimator. Good luck everyone.

Labor certified

Certificed on March 30, but just known about this.

Today is my low day, so really not too much excited about labor. My husband is sick and cause of the sick is undetermined:-((((

As I promised to myself, you guys will be the first one to know my labor condition. So here it is. Good luck to you all.

p.s. my husband's labor file the same day as mine, but his labor still pending.

Your husband must just be having some allergy reactions or flu,
since its every where now.
Keep your spririts up, he will be fine.
