RFE reply

Thanks for you update pashwin, How did you came to know that DOL entered RFE reply into their system on 28-Feb-04 ?.

My employer sent them a fax requesting status and confirmation of receipt of response to RFE. Someone from ATL DOL called back and confirmed.. also mentioned now it typically takes 2-4 weeks to adjudicate the case as it is with the officer right now.

Thanks for the pashwin. My attorney is till collecting paper work. Looks like it take a while to collect the required paper and send them.

What was your RFE all about ? what did they ask for. As you can see from the list there are more RFE's than approvals.

Frustrating thing is that we can do nothing to find out the status of the case since AVM or Ficacenter are not being updated regularly.

Only way to find out the status from either Attorney or Employer when they hear something.....

And it feels stupid to email/call attorney everyday to find out the status when we know that in this jungle rules, they can't also do much about it.....

Waiting.......waiting.....and more waiting......

Attached is a part of the email send to me by my attorney.

We received a remand notice from the DOL on your LC application. They want to know how many applicants applied for your position (based upon the ads we placed) and, if any, why the applicants were rejected.

I don't know how serious this RFE is but I am worried. I hope to get certified

This RFE is not a major issue.

It looks like that it is error or irresponsibility on part of your attorney.

For RIR application, you are required to submit this information along with the applicationl.

On my case, my attorney has submitted all the received resumes of the applicants, screenshots of Internet Ad showing how many times the job was viewed, applied, etc. Also he had compiled excel spreadsheet listing name of the applicat, date received, from what source (Internet Ad, newspaper, etc.), Interviewed or not, why rejected, etc...Unless, you send this info, how would DOL know about your recruitment efforts...Just make sure that your attorney sends presentable information.

Thanks PainCard, your answer gives me some comfort. My labor was applied approx. 16 months before, I think that is the reason it is taking time to collect the paperwork.
 
One of my luckiest friends labor cleared today 03/02/2004. He applied to state labor (GA) on June 2003. Got state cleared on Dec 2003. forwarded to federal labor Dec 2003. got the federal cleared today 03/02/2004.
Looks like it is a pure pure luck. Like a lottory.

People who have submitted the application > 2 years back are struck up royally.

If you are still surfing this forum, then post some info...on what does AVM or Ficacenter status is showing?......How soon you guys can apply the next stage, etc.....

Keep the forum moving......

RFE guys,

Let forum know if there is any effort required from your side to respond RFEs, how HR is handling, any out of the scope requirements from DOL, etc...


Waiting Guys,

Push intermediate sources (Attorney, HR, etc.) to presurize DOL and update forum on any new developments....
