Asking Help For I-130

Dear All
I've been receipted since Oct 2002 and my case was bending at uscis since that date and it was bending till they ask for evidene last week and i've send them and they inform me that they have received that evidences

Anyone tell me please what will happened next to get my GC and My Visa
 
I have no clue... :confused:



You need to provide more information. Who filed the I-130 for you, under what category? is this person US Citizen or Permanent Resident? how old are you? what is your current marital status when I-130 was filed and what is it now? what is your citizenship? What evidences did they ask for?

We are normal people here, not fortune tellers nor mind readers...

I'm Over 21 Years an unmarried son of permenant resident (GC Holder) My Dad and I'm living in africa and they asked for my birth certificate and my dad certificate

Pls Tell me what will happened next to get approved and to get my Visa

And who petitioned ? Your LPR mother ?
I'm guessing petitioner is not your father as he is living with you in Africa.

Although your PD is current now, you need to wait for I130 approval before applying for immigrant visa at the consulate.

Yes my father is the petitioner but he stayes most of the time with me in africa.

But how long will it takes to get approved ?
and what will be next this step

He travel to the states every year and stay for a monthe or something and back again .

But Nobody Tell me what is going to happened next in my case

Can you elaborate more how your father travels every year and stay for month and then leaves for africa? how does he do it without breaking the continuous residency's policy?

I wouldn't have your father sponser you, he will end up losing his GC.

In order for one to be considered as properly maintaining LPR status, a green card holder must be maintaining a permanent residence in the United States. If one is outside the U.S. for a period greater than either six months or 180 days, the immigration inspector may start questioning whether the permanent residence has been abandoned. Being outside the U.S. for such periods of time can also be a problem when applying for U.S. citizenship.

If such an individual just makes an annual or biannual visit/s to the U.S., it may appear over time that s/he is spending more time abroad than in the U.S., and actually is living and working abroad. Then the individual is at risk of losing LPR status. If one plans on an extended stay outside the United States, it is possible to apply for a reentry permit before leaving the U.S., valid for a maximum period of two years. Such a permit would greatly facilitate reentry to the United States.
 
for 6 years? what kind of medical treatment is it? is it not available in the States?

No Dear , It is not the Medical Treatment It's his sons to be with him while he is old and sick

We are Very close to our Parents in Africa.....
 
Unfortunately, that is very unlikely to be a reason to reside outside the US and maintain LPR status.
USCIS will say that he does not need GC if he isn't living in the US to be with the family in the home country.

And one more... Did he file tax to the US every year ?
