folks keep in mind that we know the things better than those attorneys. don't listen to them. but keep buggin them, for the
moving things like sending letter, for receipt number etc. don't ask these kind of questions to them.

where did you get those info. my attorney mailed my I485 application on 8/2 but i yet to get the Receipt.. may be again,
the lawer is playing on the receipt ?????

I don't think that EAD & AP will be approved within 6 days for concurrent filers. Previously, EAD & AP were sent out at or about the same time as 485 receipt. This was possible because the 140 was already approved by the time you applied for 485. However, now with concurrent filers I would think that INS has to do some sort of verification before they will send you an EAD. Otherwise someone could concurrently apply and get an EAD by making a fradulent, incomplete or otherwise uneligible application.

Updated 08/20/2002: I-140/I-485 Concurrent Filing and EAD/AP

It appears that the INS is mindful of potential abuse of concurrent filing by filing a frivous petition by some people to obtain EAD and Advance Parole. Such abuse may be evident particularly in labor-certification waived employment-based immigrant proceedings, such as National Interest Waiver, Extraordinary Worker Petition, Outstanding Teacher/Researcher, or Multinational Corporate Executive/Manager Petitions, as people in such categories can file from the outset I-140 petition together with I-485 application, plus EAD and AP applications. The INS sources indicate that the INS will time processing of concurrently filed I-140 and EAD applications such that the EAD may not be issued until I-140 is adjudicated. Since people can apply for a termporary EAD 90 days after filing of EAD application, the INS apparently is targeting at adjudication of I-140 within 60 days so that flood of temporary EAD applications be minimized to the maximum.
This developing policy of the INS gives a clue to two points. First, it appears that the INS will adjudicate the concurrently filed I-140 ahead of I-485 application separately at the earliest possible date. It is indeed a good news for those who may have to consider utilizing 180-rule under the AC 21 Act. Secondly, some INS district offices have been issuing EAD card with the I-485 Receipt Notice, but this practice can change for the concurrent I-140/I-485 filers. People should keep eye on the procedural change at the local district offices. In the meantime, people may start filing EAD application along with the concurrent filing of I-140/I-485 against the potential change in local district office procedures on EAD and AP. People may also have to give enough lead time to obtain EAD in the future and make it sure that during such EAD processing period, they maintain their work-permit visa status or unexpired EAD so that their employment is not disrupted.
 
Approved!!

We just received the mail with both mine and husband EAD! So, we called the AVM and found out that 140 is also approved!!

medical for I-485 concurrent filling

Hi experts

Please give me information about the medical needed for I-485, what all tests are needed. I am still waiting for my EB1-OR approval but planning to get the medical done and apply for the I-485.
another question is about EAD and AP. with this concurrent filling will they issue these both or only after the I-140 approval? and EAD is validity is how long?

Updated 08/25/2002: INS HQ Prioritization Policy of I-140: New Wonderland

The INS sources indicate that as the INS launched the I-140/I-485 concurrent filing, the Service Centers had been given a guidance by the INS HQ to complete processing of I-140 petitions within 60-day mark. Readers, don't be surprised if you get the news that your I-140 petitions have been approved. There are indications and signs that the Service Centers indeed have started implementing this prioritization policy. This opens a question as to its impact on the concurrently filed I-485 applications with the I-140 Receipt Notice only and without the knowledge of approval of the I-140 petitions. We hope that the Service Centers continue to adjudicate the I-485 applications without rejecting such applications or issuing RFEs. Well, we'll have to wait and see. Please stay tuned to this web site.
The sign is clear with the I-140 petitions which was filed independently and pending before the concurrent filing regulation came into effect. It is, however, unclear at this point whether the Service Centers are also adopting the same policy with the concurrently filed I-140 petitions. Please stay tuned to this web site for the development of this news.
 
Its a good news. Atleast then the AC21 benefit can be taken by us. Because, those who filed concurrently cannot take advantage of AC21 unless their I 140 is approved.

You are my source of Inspiration. I have few questions for you.
While filling-in the 485 application,

1) What should I choose as Application type in Part (2) --
A. An immi. petition giving me an immediately available immigrant visa number .... (or)
h. other basis of eligibility. Explain..

I think my wife should choose option b. (My spouse or parent applied for Adjustment of Statius)

2)In Part3:-- What should I fill in the place, consulate where visa was issued: I got the current visa stamped by the St.Louis processing center. Should I mention that?

3)C/o, A# - I should leave this blank, right?
