As long as NAMES are Pending with the FBI, they will not resend Fingerprint

You must be really SPECIAL for someone from USCIS to have actually apologized to you. I have never seen them do that. On the contrary they are rude and condescending...if they do bother to send you a reply at all. ANyways, as you cn nsee form your experience, even what they apologized for was not the correct informatino. If they were right, they would not have sent the FP notice the next day (unless they got your namecheck done the next day). I have stopped believing what they say and so have stopped hounding them. I will instead concentrate my energies on making an infopass appointment, seeing an immigration officer face-to-face, and asking about my case status. I just got an RFE on my 485 for not having my mothers full name on my birth certificate. I am currently trying to fight the authorities in Bombay and their bureacracy to get that. My parenst have already contacted some of the top political leaders in Bombay to get a new birth certificate with my mothers full name. They are giving me a hard time with that. Hopefully I will get it soon and send the RFE. But at least the silver lining is that the RFE shows that they have at least bothered to touch my 485.

Any news on your I-140? If they have touched your 485 then I-140 must be in progress/adjudcated.

The process date for 485 has been stopped in Apr 1 for about 2 months. I've heard the name check backlog for FBI is extremely long and its normal to wait at least 1 year to just pass the name check. :confused:

I did get my FP in 1 month after submitting 485 but it doesn't mean anything. By the way, with this tight and slow name check, I suspect they would approve any 485 without FP. :confused:

My guess is, for 485, it should take at least 6 months, if you are lucky. For the majority of us, 1 year should be the right waiting time. However, there are people who submitted in 2002 and still waiting. Its your call. :mad:

May I ask your RD, ND, AD of 140 & 485 ?
Was your case concurrently filed ?
 
Could anyone post the format of email and address to request the finger print notice and the status of 485?

BTW, did anyone have approval of both 140 and 485 who filed on April concurrently?

I saw an LUD on my I-140 case dated today (8/17/2005) but it did not say anything about approved or not. The last LUD was on 6/22/05, almost 2 months ago, when I had made an inquiry. I had made another inquiry last week. I dont know what this LUD is about since I did not get a reply to that inquiry.

My I I-140 got approved. This is my second I-140 ( First one was approved July 04)after my company was bought over and I had to reapply because of Succesor in interest. See light at the end of the tunnel.....although now I have to wait for the visa number availability in October.

I did send an enquiry on 8/10. Got a reply yesterday saying it was approved on 7/26. Also see that the status has been changed online too with the approved message. Good Luck to you.
 
yes I made a email enquiry on 8/10/2005 after I had a LUD on 7/26/2005. Today I got the email enquiry response saying that it was approved on 7/25/2005. Immediately the status changed in the website and I got another automated email saying that the notice was mailed on Aug 16th.

Here is what I observed. on 7/26 I had an LUD on my I-485 and on 7/27 had an LUD on my I-140. Apparently the 7/26 LUD was because my FP notice was mailed to me and 7/27 LUD was probably because my I-140 was approved. Now my question is, was the FP mailed because I-140 was cleared or because my Name Check was done? Anybody to speculate?

My feeling is probably my Name Check was compeleted (please refer to my previous post in the same thread where I posted the reply from an officer regarding my Name Check) and that triggered the FP and I-140 approval. Well anyway this is my guess and after all I might be completely wrong. Just speculating.

I quite sure your name check is cleared because then only they would have started your 485 processing. USCIS officer had been consitent in saying to all of us that 140 will be processed only when Name Check is cleared.

I would disagree, in light of non-concurrent processing, where adjudicating an I-140 would not require clearing of Name check.
It is unfair for those who apply for concurrent processing if their I-140 had this additional stage of Name check.

I think the USCIS position is to just blame all the delays in processing on back logs @ FBI's name check process.
