I think for USCIS its a matter of convenience and a matter of security and efficiency and that is the reason why we see the process changing every now and then (to make it convenient for us and for them). If we have to talk about fairness then I think we'll need a whole different forum for that. Anyway, I would not be surprised even if my Name Check is not cleared.
I'm speculating based on the information I got from USCIS and from what I read in this forum.
 
hens4rth; congrats on 140 approval and the FP notice for 485.
I'm trying to figure out whether only EB2 cases are receiving FP notice
at this time (before Oct) since EB3 visa numbers are not available.

Is your case EB2?

Finally I got my FP notice and it is scheduled tomorrow.
It seems that my case is very similar to hesns4rth's.

Hello, april guys. I'm watching this thread as the processing
seems to approach my RD.

My I-140 case is finally online because I had my lawyer
make an inquiry.

But I don't think they touched my case at all.

It takes reportedly 3-6 months for FBI to reply to inquiry to
FBINNCP@ic.fbi.gov

and the format I used

I-140 approved. Now what ?

Friends
Need some info. This is my case info.

Concurrently filed mid April 05. EB3. LC sub.
I-140 got approved this week (after RFE response).
EAD approved.

Finger printing not yet done. I-485 yet to be approved.
(pls note eb3 numbers are not available till Oct 05)

Now what should I expect in the coming weeks.

Will I get a finger printing notice now or it will be sent only after Oct (when numbers are available) ?

My I-140 getting approved .. does this mean that my FBI name check is done ?
Or will my finger printing notice be sent only after name check is done ?

Now that I-140 is cleared, does this mean that the fact that I used a sub does not matter any more. So all the issues of locating and not finding the original labor etc do not apply to me anymore ?

Pls help me form my expectations ...

Same here GC_RD_April. I hope we slowly see 485 approvals for April filers very soon...

I am not so hopeful.Looks like the USCIS dates for 485 are frozen on April 1.It might stay that way for a few more months till the backlogged cases are cleared by FBI. Has anybody who filed in April cleared the name check??. One thing I dont understand is how does FBI claim that they clear 99% of the name checks in less than 4 months when most of us have been waiting for the name check clearance since the last 5 months??

Maybe what they mean is the process itself takes less than 4 month
99% of the time. But if FBI has a big file of security check requests
untouched for months, who knows how long it will take to get to your file ?

There's something CSC specific here IMHO. CSC used to be the fastest but
now lagging behind other centers since RD of April....

One reason that has slowed CSC down could be the fact that FBI is now working on getting most of the old pending namechecks(waiting since the past year or more) completed.Recently there have been a lot of approvals for people waiting on the namecheck since the last 14 months or more. Better late than never.

You have atleast your I-140 cleared,for many of us even I-140 is pending due to name check not complete. I think its only CSC specific as other centers are approving cases filled in June.

God only knows when we will be through with this.

If this goes for extended period of time like years(hope not),
concurrent filing is actually a disadvantage because AC-21
assumes 140 approval ?

Since when 140 is tied to name check ? I thought that's basically
485 issue....

GC_RD_April,
I don't understand this, how can my I-140 be approved before others who filed before me while even my I-485 is stuck because of NAME CHECK. I think there is some confusion here. Have you emailed to USCIS regarding your case? I sincerely belive that there is no link between I-140 or FP and NAME CHECK but then again... all I know is USCIS works in their own way... there is hardly anything concrete about what they say and do.
