Abolition of Asylee Cap is in the bill?

Asylee cap abolition is already in the bill that passed the house today..Then why are we all worried? If most of the house voted for this..why would they take it out? Since Senate has been Pro-Immigration always.. I am confused as to what are we scared of?....or ailf wont argue for it...Can someone explain?
 
Looks like Asylee CAP abolition was ADOPTED in the bill..read this

PART A--SUMMARY OF AMENDMENT CONSIDERED AS ADOPTED
Manager's Amendment. Removes the annual cap on the number of aliens granted asylum who can become permanent residents. It would also extend the bill's provisions regarding the credibility determinations of immigration judges in asylum proceedings to apply to other requests for relief from removal before immigration judges. Ensures the prompt removal of criminal aliens and terrorists who pose a threat to our national security. It would clarify that no county administrative agency, quasi-state Commission or state administrative agency, or state-authorized Commission can hear any cause or claim to block the completion of the border fence between San Diego and Tijuana. Adds Secretary of Homeland Security to Attorney General and Secretary of State for purposes of making decisions on the inadmissibility of terrorists. The amendment would also make a series of minor and technical amendments.



PART A--TEXT OF AMENDMENT CONSIDERED AS ADOPTED


f) Removal of Caps- Section 209 of the Immigration and Nationality Act (8 U.S.C. 1159) is amended--

(1) in subsection (a)(1)--

(A) by striking `Service' and inserting `Department of Homeland Security'; and

(B) by striking `Attorney General' each place such term appears and inserting `Secretary of Homeland Security or the Attorney General';

(2) in subsection (b)--

(A) by striking `Not more' and all that follows through `asylum who--' and inserting `The Secretary of Homeland Security or the Attorney General, in the Secretary's or the Attorney General's discretion and under such regulations as the Secretary or the Attorney General may prescribe, may adjust to the status of an alien lawfully admitted for permanent residence the status of any alien granted asylum who--'; and

(B) in the matter following paragraph (5), by striking `Attorney General' and inserting `Secretary of Homeland Security or the Attorney General'; and

(3) in subsection (c), by striking `Attorney General' and inserting `Secretary of Homeland Security or the Attorney General'.

(g) Effective Dates-

(1) The amendments made by paragraphs (1) and (2) of subsection (a) shall take effect as if enacted on March 1, 2005.

(2) The amendments made by subsections (a)(3), (b), and (c) shall take effect on the date of the enactment of this Act and shall apply to applications for asylum, withholding, or other removal made on or after such date.

(3) The amendment made by subsection (d) shall take effect on the date of the enactment of this Act and shall apply to all cases in which the final administrative removal order is or was issued before, on, or after such date.

(4) The amendments made by subsection (e) shall take effect on the date of the enactment of this Act and shall apply to all cases pending before any court on or after such date.

(5) The amendments made by subsection (f) shall take effect on the date of the enactment of this Act

It's nothing to be scared but the thing is to get it in the floor soon It should have the votes and pass the senate or the WH would not support it the way they did today but I think it doesn't hurt to write a fax or email. AILF,AILA diff lawyers org and about 130 left leaning org are arguing against it and don't forget many senators unlike the house reps. are lawyers too.

To quote The LA Times article you posted, today's house action presages "a potentially bruising congressional battle on immigration reform." Just this morning liberal Senator Kennedy and conversavtive Senator Craig jointly introduced an amnesty bill in Congress. A major overhaul of the immigration system is probable this year. When you throw in the homeland security concerns into the picture, you will see an incredible and strange mixture of political currents at work. No one can anticipate the outcome of this. One thing is clear, though. Groups like AILA will have a lot on their plates. Those concerned with asylum issues will try their best to defeat the provisisions that so severely restrict future asylum applicants. Other advocacy groups will try to legalize status of millions of folks who are here in undocumented status. These NGOs have limited resources and they cannot do everything at one time. Right now the biggest booster for removing the cap is the White House. There is a credible risk that the asylee adjustment can become an orphan that is left out of any final immigration reform package. It is incumbent on us to convey to them the importance of this. If we do not care, who will?

I did some digging and found that the bill introduced yesterday by Senators Craig & Kennedy is:

S.359
Title: A bill to provide for the adjustment of status of certain foreign agricultural workers, to amend the Immigration and Nationality Act to reform the H-2A worker program under that Act, to provide a stable, legal agricultural workforce, to extend basic legal protections and better working conditions to more workers, and for other purposes.


The full text isn't available yet as it was just introduced, but I will try to post the summary of the bill when available.

I hope you are right Gilbert - and that this year is a year for great immigration reform. I am looking forward to positive results and I agree that congress is ripe for changes to our immigration laws.

Either you don't know how to read or maybe I don't know how to read....The first part says that:

1)...The revisions contained in his amendment (and now in the bill that passed) were substantial:

* Eliminated the asylee adjustment cap. While this is obviously welcome and long overdue, it is little consolation against a backdrop of provisions that will make it nearly impossible for many asylum seekers to find relief here in the future.


So here it means that elimination of ASylee cap is in the bill ok?

The second part where you cut and pasted..while not reading the whole thing says..

5) The House defeated two additional amendments. The first, offered by Representatives Jerrold Nadler (D-NY) and Kendrick Meek (D-FL), sought to strike the asylum provisions from H.R. 418 while preserving the asylum provision in Representative Sensenbrenner’s Manager’s Amendment that would eliminate the asylee adjustment cap. The amendment failed by a vote of 185-236. View the amendment.

This means taht an amendement was requested to get rid of all other mumbo-jumbo and leave the elimination of asylee cap in the law which failed..which means the mumbo-jumbo and elimination of asylee cap is in the bill..

Get it??

If you introduce an amendment to include something already in the bill + more and it gets defeated it doesn't mean the THING INCLUDED IN THE BILL ALSO is OUT..get it?..mumbo jumbo Geez!

I concur with you. It is pretty clear that HR 418 includes the annulment of the 10,000 cap. I don't know how newcomer01 overlooked this vital provision of the Bill. I am assuming it is an oversight.

This is not a done deal. It needs to be approved by the Senate and the President.

This is why the other thread is asking people to contact their senators.

There is no timeframe at all. Congress can act as fast or as slow as it wants. Or the Senate could choose not do to anything at all. In that case, the bill would be null and void when Congress adjourns in late 2006. To go back to my original point, this is why I think the letter writing is so important.
