7th Year H-1B extension with Priority Processing

Hi All,
My 6 years H-1B will be expired in Jan. 2004. I'm still waiting for the LC, and it's been more than 365 days. I'm preparing for the 7th Year H-1B extension, but I was wondering how long will it take to be approved. Can I submit the extension with a priority processing? How do you do that? I'm in PA.

Pay the premium processing fees and don’t forget to attach your LC pending evidence that is SESA or SWA letter sent to your lawyer or employer when they submitted your LC. That letter from SESA has your name, case# and PD on it

One more thing. When I submit the 7th year extension, I assume that I can include the H-4 extension as well. Is that correct?

My company lawyer has applied for my 7th year extension in Vermont during july 2003. It is based on my previous employer's LC which is pending (!) for more than 365 days. But I did not see any receipt notice of the LC attached with my application. The H1-B application just had the copy of the whole LC filing. Thats it...

Am I screwed or is application a potential candidate for RFE?...

Any Idea..... (My previous employer filed my LC in NJ during July 2001 and he is out of business now. So no way of knowing the case no or any details about it.)

Any info will make me feel better.

You can include H4 extension

--- you may get RFE, you still can get letter from SESA that your LC was applied and SESA will send a letter to your lawyer if RFE then attach that letter as evidence of filling LC more than 365 days

Hi Ginnu.

As you guessed my application got RFE yesterday. (My receipt date for H1-B 7th year is July 23rd) I don't know what document INS is asking for, yet.

In case if the the RFE is for the LC receipt date from NJ SESA, do
you have any idea about how many days it would take for my lawyer to get the LC receipt from SESA. A Week or more?

Anybody has any idea...I am a little worried... Thanks......

Did you come to know what for the RFE on your H1 extension? I am in the same situation, my attorney applied for 7th year extn without the LC receipt (NY) and I am expecting the RFE.

Please let me know if you find any info on how to get LC receipt and how long would it take.

We have not received the RFE letter (???) yet. My lawyer will first receive it and I will share the info to you for sure.

My lawyer got the RFE information and as I guessed, it is the LC Receipt notice. I will let you know more as I proceed.

Did the same thing in Jul (exp in Aug). Albeit my 140 was already approved.

I got the approval in abt. 7-10 days.

I'm not sure about the paystub. The paperwork is at home. If I get a chance I'll have look at it and let you know.

But if you have 1 I see no harm in including it in.
 
One more question to Ginnu and all:
When we do the 7th year extension, do we have to do "prevailing wage" again?

I am working for an american company and my H1-B period is expiring in 2004 Janauary. Recently my company applied for 7TH year extension and my question is while i am on 7th year extension if i get force adjust can i join with company B which i already got H1-B from them and based on the labour pending more than 365 days from the current company

will appreciate for any info
 
LC Receipt Notice

Hi kv2002,

Did you get any chance to get your LC receipt from local SESA. I guess I will face the same problem because my attorney didn't receive any LC receipt from Harrisburg SESA. I will apply for my 7th year extn by January.

The lawyer who applied my LC (for my previous employer) tried to contact NJ-SESA and they told her that "NJ-SESA absolutly do not give out any receipts". But in my case the LC had a query with a date of May 2003 and NJ-SESA people told her to use that as evidence that LC was older than 365 days. The lawyer is going to send the delivery confirmation of LC application to NJ-SESA on Jul 2001, along with the query notice. I believe the query is for High prevailing wage or something. Anybody knows what that is???

I am clue less and I don't know what will happen when INS receives these doc's evidence. Do they do more investigation using the case no of LC to find out whether it is active or not?
I am little worried because, my LC which got query was applied by my previous employer and he is out of business and no one answered the query also. That LC is not going anywhere. My current employer applied for a new LC 4 months back..

Its all in a limbo state....I will sure update the status.

---- That is wrong info from lawyer, NJ SESA sends receipt, and if not received the lawyer can talk to SESA NJ in Trenton they will send the receipt in 4-5 days, my friend lawyer got third day he spoke directly to officer on phone

---- if that query has PD and Case# and your name( I hope all will be on that) you can use that as evidence

---- I guess Your lawyer/ employer might have written fewer wages for your job title the SESA may want it to be increased on FORM ETA750A, I am not sure as I have not read the query
