hi
I have been a permanent resident in the US for 5 years now and am eligible for US Citizenship. However I may be taking up a job for an American company abroad. What are my options ?
1. Can i apply for US Citizenship from abroad?
2. Do i need to apply for a re entry permit before i leave?
3. Is it the I 131 or /n-470?
4. Would my time away be counted towards my GC?
Please advice and point me in the right direction.
Thanks

1- You can not
2- Yes if you stay abroad for 2 years maximum
3- I-131
4- No. Working on American company aoutside the US has nothing to do and you are not obligated to do, this is just your choice.

mmed's answers are not entirely correct.

For (4), the time outside the US will be counted towards the citizenship residence requirement if an N-470 is approved (and one actually goes to work for the employer listed on the N-470, of course).

so if i was to stay abroad and work for an American Company outside.

1. I need to get I 131 done if i was to stay for 2 year maximum & apply for N-470 if i want it to count towards my citizenship
2. Only apply for N-470
3. so say N-470 is approved i still cannot apply for citizenship from a foreign country or do i need to be back in the US

Thanks

A1: You need your N-470 approved if you want that time to be counted. Just submitting an N-470 will not cut it.
A2: N-470 and I-131 both are needed. They serve different purposes.
A3: Need to be in the US

Just out of sheer curiosity, how many years did you live in the US while awaiting your GC to be approved? How many years since your GC was approved?

Green card holder returned US on returning resident visa want to apply for Citizenshi

I have been a permanent resident since 4/30/02 and have made several trips abroad (dates of travel for last 5 years listed below). I was also in India for about 2 years between 1/30/05 to 03/02/07 and returned to the US on a returning resident visa and USCIS allowed me to retain my green card. I have been physically present in the US for about 27 months in the past 5 years. I was wondering when would be a good time for me to apply for my citizenship.

Dates of travel:
----------------
8/30/03 to 9/21/03
4/9/04 to 4/13/04
6/16/04 to 6/23/04
1/30/05 to 03/02/07

Please let me know when I can apply for citizenship and what would be your fees to assist in applying. Also, are there any financial requirements like minimum income, bank balance, income in tax returns, etc for applying.

Looking forward to hearing from you.

Your long trip broke continuous residence, so you must rebuild 4 years and 1 day of continuous residence to become eligible for citizenship (luckily they don't make you redo the whole 5 years). So that would be 03/03/11.

There are no financial requirements, other than showing how you supported yourself financially without criminal activity, i.e. either you should have been employed most of the time, or be able to show that you had enough savings to go without working for long periods of time, or show that somebody else such as a spouse or relative or charity was supporting you. You would bring that evidence to the interview, in case they ask for it (they won't always ask for it).

Unless you have a history of arrests or convictions, or take another series of long trips, you should be able to apply without assistance from anybody else. Download the Guide to Naturalization, and also download the N400.pdf and its instructions, spend some team reading them and you should be OK.

I found following information on another thread:

"Application preparation:
* Gave departure date as May end, reason as temporary work assignment abroad
* Included personal checks of $385 for adults and $305 for kid
* Did not include covering letter or passport photos
* For each adult application affixed a sticky saying *EXPEDITE request for Biometrics alone*
* Put all applications into single envelop and marked outside of envelope as *EXPEDITE*

Processing timeline till date:
04/17: Posted the applications via priority mail
04/24: Personal checks got encashed by NSC and assigned LIN#s posted on back of checks
04/24: Case status online for these LIN#s show ReceiptDate as 04/21 and LastUpdatedDate as 04/23
05/02: Received original I-797C receipts AND Biometrics appointments (all with code 3) for adults & kid scheduled for 05/07
05/07: Visited assigned ASC and completed Biometrics -- 10 Fingers + photo for adults, IndexFinger + Photo for kid
05/08: Case status online LastUpdatedDate changed to 05/08 without any change in status text"

I am going to accept a new job at Singapore with a foreign employer with little presence in the US. I have had my GC for last 4 years now. My question is about I-131 re-entry permit and N470..

First I-131:

This note above lists the process very succiently for filing I-131. I have couple of follow-up questions.
1. The purpose was put as "temporary work assignment abroad". Does one need to provide any backup for that? Offer letter/Transfer letter etc.?

In my case I am taking up a new job in Singapore. I am not sure how things will go in the new job, if it all works out then we may decide not to return to US however, till I am sure I don't want to give up my GC status. Any ideas on how to approach this?

Did you include any pre-paid self addressed express mailers? I am not sure what USCIS means by express mailers. Can somebody elaborate?

2. Am I be eligible to apply for N407 (I believe this is the form to meet continous stay requirements to apply for Citizenship later)

Any help will be appreciated.

thanks

You don't need to provide that up front. But you should be able to produce it if they request such information while processing the I-131, or at the port of entry when returning to the US. The assignment should have an expected end date, it should not be open-ended employment, and the letter should reflect that.

I don't think so. For N-470 approval a nongovernmental employer must meet the definition of a "US corporation" (over 50% of the shareholders are US citizens or it is exclusively traded on a US stock exchange ... there may be more conditions that would satisfy the definition, consult a lawyer for details if you think the company has a chance of being seen as a "US corporation").
