2005 Consolidated Tracker (140/EAD/AP/FP/485)

Just got an email from uscis with the good news : my LC has been approved. Judging from the different messages on the response time from USCIS, I think I belong to the "lucky" cases that were approved in a relatively short time (my receipt date was 12/6/2005).
My lawyer filed my case as EB3 which means that I'm simply back into another loooong line until my PD (10/21/2001) gets triggered.

I suspect there could be another year or so of waiting time before they reach my date... patience is a big !#$ virtue :rolleyes:

I don't think it will hit snail pace.. here is the reason for my optimism :-
"Between 2002 & early 2005 EB2 & EB3 both were current....
No one really has to file for EB2 & go through extra pain of showing EB2 criteria satisfaction.. I am EB2 PD 091505 (My User ID duh...!)
I ran some numbers and I placed my self between 103,000th (worst case) & 91,000 (best case) person in EB2 queue...
Ok I, will do my numbers:
345,000 cases in Backlog so lets take 1/25 ratio for Eb2 since lot of these are 245(i) & don't qualify for EB2.
I was 56000 in Perm filing from ATL center so lets take another 75,000 from Other perm center.
so we are looking at 15000 + (75000+56000)*1/4 (Since EB2 suddenly became hot during perm due to retrogression).. so I am about 40,000th In queue plus multiply this number by 2.25 & we come across 100,000.
1/25 ratio was obtained by me watching "60 minute" which quoted lot of illegals did had their masters & they said about 10,000 people in 245(i) had masters or better...
I don't take into consideration people who will do jumping but it's too risky & I am sure not too many of them have balls to do this.

Actually... USCIS has already said that EB2 progress will slow down or stop by mid 2006. This can be interpreted as March or June 2006 for the anticipated slowdown for EB2s...

They have also said that early 2006 will be faster movement and then when visa #'s start slowing.. worldwide #'s will start retrogressing.

So, yes we can hope and certainly optimism is a good healthy feeling but only when taken with a sniff of reality. Expect this progress to slow down in the next few months. Here's what we should hope and posssibly work towards.

1. Hope that if you are early 2002 or mid 2002 priority date, the current pace will pass your PD and you will be among the lucky ones in the next couple of months. I certainly am keeping my fingers crossed on that one.

2. The immigration reform bill that congress and senate is supposed to work on, if it ever happens will need intensive lobbying efforts from the legal immigrant community, businesses et all to include us. This is the ONLY way for legal EB3's and possibly the ONLY realistic way for 2004+ Eb2's in the next couple of years.
 
USCIS did not specify that EB2 will stop or slow.they said in general EB based preference quota's.probably they woul d have meant 245 with EB3 inclusion.That was my inference from Oh Law-Breaking news page.

As you said till mid-2002 its going to move for sure in next coupla months.from then onwards till becoming current is a million dollar question.
Forget about the any new immigration reforms..my guess is its not gonna happen.Bush has much higher priorities to do ..like Oil dril,Medicare,War,etc and this will be in his last page of to do list.

with h1b for Masters over now..its gonna be interesting what will the next step ..either to increase quota or to just while away time till oct 06.

I'll defer with Spidy on only one point. ... Slowing down on EB2 .... I think USICS is consistent in reporting eventual slow down of employment based visas and not exclusive slow down of EB2.

Notice the tone and rhetoric USICS has used by USICS over last half year:

They are consistent in reporting on
1> Limited availability of visa numbers under employment bases category (restricted by law).
2> Higher influx on incoming application.
3> Possible measure of “retrogation for some countries and may be worldwide for the employment based category.


I agree with Spidy’s speculations about immigration reform bill to be only long term workable option for resolving the backlogs and reducing wait times.

BUT …. Time will tell. I’m going to watch next few months very closely.
 
EB3 Retrogression

I guess that most of the illegal immigrants are NOT from China or India and hence less chinese and indians in the Apr'2001 pool. Do you guys think this will make EB3 retrogress dates for these coutries move faster than expected?

Any comments?

You know I had the same theory, I had posted this months ago, possibly on the BEC thread when I was stuck there....
It makes sense to me BUT I have a nasty feeling this business of visa # availability is not as clear cut as this theory sounds...

Here's what I think happens.

Assume a few things here... and go along with me pls.
USCIS expects 10 Mexicans to immigrate this year.
Mexicans have total 100 visa #'s available to them.
Indians and Chinese total ppl in line are 500 (250 each thats prolly a fair proportion)
Indians have 100 visa #s
Chinese have 100 visa #s available to them.
Now USCIS goves India and China 45 extra visa #'s each bcause Mexicans left 90 open.
Suddenly in comes 245i and all the illegal mexicans get line and use up their 90 visa #'s and the 90 extra #'s are no longer going to be available for Indians and Chinese.

So you see, we're all screwed in the end.

Can you guys throw some light on security, name checks? how do we know whether they are completed or not.

what is the best case and worst case. I have been hearing from couple of my friends that they have been stuck in these checks for last couple of years.

Also when should we call VSC for enquiring the status of this checks...

The more you have moved, the more time it will take to check your background.
Also, the smaller the city that you come from, the harder it will be for the FBI to do a security check on your past, plus the less # of yrs you have been in the US, the more important it is to have this information from your past and possibly foreign origins...

All these things are obviously very different in each of our backgrounds which can make for varying degrees of time it takes to complete these background checks.

Now, I have recd fingerprinting results recd LUDs twice on both our 485's... I suspect one was for a name check and the other was for a fingerprint check.. there should be one more for the security check.

Fingerprint and name checks are when they run these 2 against the various national and international databases of known criminals.... obviously if they find a match then the scrutiny is intensified.
Security check would be where they go to your local police stations etc... and check to see if you were every in violation of crimes that may cause them to raise a flag... this also where they would go to, India, say to your city of origin to check that you are not a local mafia don trying to immigrate to the US...

Of course, this is all information I have gathered by reading and some deduction.. none of this is guaranteed fact or anything close to that so please take it with a grain of salt and do your own digging....

I was quite curious to know because most of the cases are not stuck and I read somewhere that the FBI takes long (years) for only some cases (around 10-15%) and remaining cases are cleared quite faster.

As I check my mails again I have got mails saying fp results received on 25th and online message says fp results are received on 28th.

It seems there were two fp results received one on 25th and another 28th.

Online EAD renewal?

Just was wondering if anyone in this forum has experience with online EAD renewal? I would appreciate any input in this regard. Also, could anyone suggest a lawyer/ paralegal who would do this renewal for a minimal charge. My lawyer wants big $$ just for fees for the renewal of EAD/ AP.

I have a question .Please Help me ..... My spouse EAD and AP is pending for a long time ... I started suspecting that did they abandon her 485 .. since she travelled when her AP was pending .... Please help

quetions
1) what is the procedure reapply when a 485 is abandoned .
2) can we reapply ?
3) how will we know if the 485 is abandoned ?

Thanks for your response. As long as those illegal immigrants don't take away our visas, i guess there won't be any problem in crossing the april'01 hurdle. May be cut off date 04-01 will stay forever for Mexico i guess. My PD is 02/02 and honestly i want this EB3 retrogress date for India to move to that date as early as possible.

What do you mean by "abandon her 485"? You can always check the status online. In this thread if you look you will find the url. This will answer your Q3.

Answer to Q2 is No as far as I know.

Your lawer should be able to query USICS on the status of long pending case.

The status on our 485 shows as pending .... ( My friend's 140 when denied did not get updated on the web site )
I have asked my lawyer about the status enquiry , they did that in the first week of jan ... waiting for a reply.......

sorry for posting this question here, but i tried the h1 thread first without any luck. hoping you can help or point me in the right direction.

does any one know if the cap for h1bs has been reached or if it's still possible to apply for a h1b? also, do you know if pharmacists are affected by the cap?

As per current expectation on old PD application will go fast,
one of my friend got fast approval from VSC.

there may be chance 485 approval also very short period.
