Attorney gets a copy and Employer also get a copy. Atleast this happened in my case.

Looks like VSC is approving cases. The cut off date posted on the web site ' May-21-2004' , is not a true indicator. Wish ALL of you who have been awaiting I140 approval , best of luck. This forum has been very helpful to me.

Now the endless wait for I485 begins......... :rolleyes:

I got RFE on my I-140. The RFE has two parts.

1. Submit evidence to establish that the employer had the ability to pay the proffered wage or salary certified in the form ETA 750B as of the filing date and continuing to the present.

2.Submit documenation that the beneficiary qualifies for the job offer specified in your application for labor certification Form 750A from the DOL. The documentation should show that the required experience, training, education for special requirements as of the time of the filing From ETA 750A.

A) If eligibility is based on experience or training letter(s) from current or formers employer(s) or training should be submitted.


B) If eligibility is based on education copies of the transcripts of the beneficiary shool record should be submitted.



I already submitted the transcripts/experience letters. Why again they asked for the experience letters? How difficult to justify the A2P. My employer says he has the necessary documents to prove A2P. My company employs about 25 people. My labor PD is OCT., 2001.

My Labor just got approved and I am going to file my I140 and I am just curious to know how many days it takes for I-140 approval from VSC??
Another question, when does the AC21 will kick in?? Is it 6 months after I-140 approval or 6 months after filing I-140??

does ur labor say bs+5yrs is acceptable or strictly ms degree

i guess u must resubmit all docs again if u already did

Congratulations on your labor approval and before asking these questions, you should have gone through some previous posts in this forum so that you will get some idea.

To answer your question, best case 1 month worst case 1 year. Nobody knows clearly, it definitely depends on your case, employer etc.

Coming AC21, in order to get portability benefit, the 6 months is after filing 485 and not 140 eventough you need an approved 140 before filing for AC21 to change employers.

Does anybody know if a applicant should keep a copy of the 140 approval. Which may be needed in interview, AC21, any RFEs etc.. Just in case? OR just knowing EAC number of the filing and it's approval status is good rnough ?

Good to keep copies of everything in general.
But yes AC21 will require you send in copies of approved 140 and receipt # of 485 to prove AC21 requirements were met. (approved 140 and 180 days since 485 receipt)

I have also kept copies of labor certification and my entire packet that went out to USCIS.

CONGRATS !!! Looks like VSC has started processing I140 cases filed by Sept end 2005.

I wonder why has VSC not changed the cut-off date for I140 ( which is 21-MAY-2005 ). I guess there may be some sticky cases filed during May-June 2005.

Mine is for one. Not sure what is so sticky about it.

Need guidance on the following :

1) I have got an approved I140. By APR-2006 my application for 485 will complete 180 days of filing. Should I file for H1B extension under AC21 for the next 3 years ?

2) Since I have got EAD , does it make sense to file for H1B extension ? If Yes , then under what circumstance ?

3) Does the H1B extended visa become invalid if my 485 gets denied ?

My questions may seem elementary , but any help is greatly appreciated.

you could file for 3 year ext with approved 140.

no meaning if every thing go well...

It usefull when.....say company fired and changing employment b4 180 of 485 filing

If immigration visa approved then NON Immigration visa will be nullified.
If imm visa denaid then you can get valid status with NON immi visa.

So as per your response :

1) If I loose my job in future or if my company shuts down , my GC will not be impacted. All i need to do is to transfer my H1b to a new company...right ? I was under the impression that I can just join a new company using my EAD and keep my GC process going ...is this not true ?

2) If my I485 gets rejected , the extended H1B visa ( for 3 years ) will not be impacted. So , I can transfer my H1B visa to a new company and maintain my legal working status...right?
