2005 Consolidated Tracker (140/EAD/AP/FP/485)

LUD effect on 140

Number of people getting approvals/RFE in this week who got LUD on 1/27 on 140 cases with old PD.

I noticed number of people got the LUD in VSC cases.

What is the meaning on this?

congrats! Lucky u. U got approval in less time. All the best for 485.
I am still waiting for my I 140 approval. USCIS is testing my patience.
 
My case is filed in EB3....

Company has merged

Hi Guys,

Need your opinions / expert advice.

My employer has merged with another company.
I would like to know how will this impact my GC process and what do I need to do.

Labor : PD = Aug-04, AD = Aug-05 :)
I140 : RD = 3-OCT-05 , AD = 17-JAn-06 :)
EAD : RD = 3-OCT-05 , AD = 21-Oct-05 :)
485 : RD = 3-Oct-05 , FP = 01-Nov-05 AD ????

Does this merger makes the I140 invalid ? What needs to be done in case of pending 485 ?

I-485 denied because of I-140 denial

Hello Jharkhandi, United Nations and all other gurus please help...

Last night(17th Feb'06) my I-485 rejection letters( it is all because of my I-140 denial) . Still waiting for the letter from INS (do not know what it could be). I' m still suspecting whether the ORIGINAL labor is not used in this process.

What are my options at this point of time...

1. To file MTR and get the case reopened after seeing the Original denial letter from INS
2. File another 140 in EB3 category while the MTR is pending..
I do not have any H1, as I've stopped extending it since last year..

Please , please send me any info / thoughts/ suggestions in this matter...

My case details :
Jan 2001 Labor PD (Substitute) EB2 case
Filed 140 and 485 in Feb 2004
Got an RFE on 140 in Feb 2005 (for both ability to pay and for the original Labor copy)
My employer and the attorney (who maintains a great website ) said that they have never used this labor to anybody else...
RFE replied in June 2005
After that tons of updates on my case and my wife's case
Working on 2nd end and ready to go for 3rd EAD soon..(in another 2 months)

Title 8, Code of Federal Regulations, in part 245.2(a)(2)(i) states:

Before an application for adjustment of status under section 245 of the Act may be considered properly filed, a visa must be immediately available. If a visa would be immediately available upon approval of a visa approval of a visa petition, the application will not be considered properly filed unless such petition has first been approved. If an employment based petition filed for classification under section 203(b)(1), (2) or (3) of Act is submitted simultaneously with the adjustment application, the adjustment application shall be retained for processing only if approval of the visa petition would make a visa immediately available at the time of filing the adjustment application. If the visa petition is subsequently approved, the date of filing the adjustment application shall be deemed to be the date on which the accompanying petition was filed.

The immigrant visa petition filed in your behalf was denied.

Absent evidence that you are entitled to any other immigrant classification, your application must be , and hereby is denied.

The regulations do not provide for an appeal from this decision.

I am new to this forum. Pls bear with my basic questionb.My I140 has been filed on feb 10, 2006. Not sure what is LUD?
Is LUD , Last Update Date?? If so, How do you get that details??

This is what it means :
AD - Approved Date
RD - Received Date
ND - Notice Date
PD - Priority Date
LUD - Last Update

Go to https://egov.immigration.gov/cris/jsps/index.jsp and Register your case details there. When you register you would see the following columns:
Receipt Number - your EAC#
E-mail : Flag to receive notification upon any changes in ur case
Last Updated (mm/dd/yyyy) : this is LUD
Form # - like I-140, 485 etc...
Form Title - name of the case..

Also go through this forum and you will get an idea as to what is been talked/discussed about.

I did register in uscis and I did see the "LUD" on 02/15/2005. MY rd is 02/10/2005.
Is it possible to have some updates on mine case with 5 days??

It is normal that you will see some LUDs without any message change and you won't get any notifications.

If there is any significant update like RFE, Approval etc will trigger notification as well as message change.

so just hang in there...the number of LUDs are not uniform and depends on individual case...so don't worry.

Congratulations ask_gc for your 140 approval.

Regarding my 485, there was an LUD on 02/09 without message change. After that I am checking the status very often but no luck yet.

The message says my FP results are received, don't know whether that includes name check as well. I will wait couple of weeks and then will call them for status.

Finally 140 approved!

Today morning I got the magic mail,that my 140 is approved on 21 feb..........there's on lud after ND.

My time line is:

EB2/RIR/PD 04,2002
LABOR APPROVED 06 2005
CONCURRENT FiLLING ON 07 2005
EAD/AP AD-08 2005
140 AD-02 21 2006

485 still long way to go,but crossing my fingres for good :)
