hi all... havent checked the site for a couple of days.... real happy to see all the approvals. Congrats to everyone that is done.

I got email that my 485 is approved on June 8, 2005 and approval notices is mailed....
but my spouse case is transfered to Washington, DC office. don't know why/ any thought..

Is the H1 completing 5 years or 6 years? Your post was not clear. Anyway, here is my opinion and what I have decided upon in April this year when I encountered similar situation. If full 6 year period on H1 is ending then switching to EAD would be the right thing cost wise, if you have to pay for it. But make sure you have advance parol also applied/approved because both of you will loose visa status and fall under AOS. But if the H1 period is completing 5 years and not 6 years, then it is upto you to decide what to choose. Denail of 485 should have a strong reason, at teh least you may get any RFEs if any documentation is missing.
In my case I didnot go for 7th yr extension and used my EAD, luckily in May 2005 I got approval. If I had applied for 7th yr H1 I would have lost $3000/-. Make sure you always have valid EADs and APs if you dont use H1/H4.
Also, it is my understanding that 7th year H1 extension is based on the pending 485 status or pending labour more than 365 days. If in case your 485 got denied, it is no more pending since a decision was taken by USCIS, in that case I dont know if H1 extension stays valid, it will be waste of money.
My attorney warned me that there is a risk in case of 485 denial and not having H1 but I thought a lot and ingored their warning because of the above reason.
ANyways play a safe game and do whatever works better for you. I would appreciate if you post the case details in your signature to know more because people like me are spending some time to share some information.

and one more thing bcoz of the retrogression of the PD S .i think it will take a long time for our gc process since our pd is in 2003 and also EB3 category.so do we still need to continue on EAD OR GO FOR H-1 EXTENSION.

since there is 1 yr 4 months of normal H-1 left , it might make some sense to renew it..God forbid if something happens with 485 , u can still do an H-1 transfer and maybe go for perm or something..

But since 140 is approved , how much chance is there that something might go wrong?I think very less. Also , You are already nearing 6 months after applying for 485 .

It has other minor implications though..If u are planning to apply for mortgage and all, it is much easy to convice the bank if u have H-1(they all know abt it)I recently had to spend some time to convince them abt AOS , that i am in a safer situation than on a H-1.

As desi_ma suggested, since you have 1.5 years of normal h1 period left, you may go for ext , it is upto you to decide. In my case, it was very close to approval and would have been a waste of money if I had applied for 7th yr extension. But consider other factors like getting stamped when you travel outside the country with H1, etc. You cannot send it to DC office anymore. Consider all the factors and take a wise decision, goodluck.

Update - LUD Changed

Hi,
For me LUD and message has changed yesterday and it says 'On June 7, 2005, the card order was completed and we mailed the applicant's new card....'.
Still for my spouse msg. and LUD remain unchanged.

As I have a lud for my 140 case on 3rd feb 2005 after applying on Aug 12, 2004. Message is same as it was first lud on Aug 18 for application receipt. Lots of 140 applications got approved in Feb-2005. Do I need to worry about 140. what you expert guys think. No RFE, no lUD, no appoval yet. Mine is concurrent case.

Any thoughts will be appreciated...

Congrats!!! fromcn, seems FP done on 4/8/05 from boston got approved yesterday, I see NF-kappaB also got approved with same dates and same place.

Anybody from Newark,NJ got approved with FP Date 4/8/05 or atleast April 2nd week cases?

I think you should initiate a formal inquiry through your employer and/or attorney. Your 140 is way overdue...
 
I'm overwhelmed!

I've checked my e-mail yesterday only to find that my I-485 has been approved! Thanks to everyone on this forum, the info and opinions stated here are indeed very helpful. Good luck to all!
