Finally Got My 485 Approved

Hi,

I have been a silent reader of this forum. This site has been very helpful in knowing the trend. Thanks guys for the info and encouragement.

Yesterday night I got the following email

Receipt Number: EAC042505xxxx

Application Type: I485 , Application to Register Permanent Residence or to Adjust Status

Current Status:

This case has been approved. On June 6, 2005, an approval notice was mailed. If 14 days have passed and you have not received this notice, you may wish to verify or update your address. To update your address, please call the National Customer Service Center at (800) 375-5283.

My details are

Labor PD July 2001
I140 RD 08/30/2004 ND 09/07/2004 AD 11/08/2004
I485 RD 08/30/2004 ND 09/07/2004 AD 06/06/2004
FP Done on April 9th 2004 (at Newark)

I didnt get a 'finger print recd and case resumed' message. My spouse had this message change though. Now I am relieved :)

How did you get VSC rep to tell you things like "name check is pending"? What numbers did you dial, what options did you choose, and what did you say to the rep to let him/her tell you more than the status check on the USCIS website can offer?

There was another LUD on my case on 06/06..Can anybody of you see a pattern or indication here? I would greatly appreciate some insight by the gurus in this forum..

help needed

hi guys

we r in a dilema plz help. my husband is on his h-1 and he is on his 5 th year termination.and his visa will terminate in july. he is having EAD.now he is planning to extend his h-1 . his employer asked 2000$ for h-1 extension. now he doent want to spend that much money and wants to continue on his EAD.

WILL THERE BE ANY PROBLEM IF HE CONTINUES ON HIS ead. since we heard that if he continues on his ead some time in the future if a problem arises and his pending I-485. WILL BE REJECTED.IS IT true or not or is it WORTH TO CONTINUE HIS H-1 EXTENSION. please can any one help in this regard.

Is the H1 completing 5 years or 6 years? Your post was not clear. Anyway, here is my opinion and what I have decided upon in April this year when I encountered similar situation. If full 6 year period on H1 is ending then switching to EAD would be the right thing cost wise, if you have to pay for it. But make sure you have advance parol also applied/approved because both of you will loose visa status and fall under AOS. But if the H1 period is completing 5 years and not 6 years, then it is upto you to decide what to choose. Denail of 485 should have a strong reason, at teh least you may get any RFEs if any documentation is missing.
In my case I didnot go for 7th yr extension and used my EAD, luckily in May 2005 I got approval. If I had applied for 7th yr H1 I would have lost $3000/-. Make sure you always have valid EADs and APs if you dont use H1/H4.
Also, it is my understanding that 7th year H1 extension is based on the pending 485 status or pending labour more than 365 days. If in case your 485 got denied, it is no more pending since a decision was taken by USCIS, in that case I dont know if H1 extension stays valid, it will be waste of money.
My attorney warned me that there is a risk in case of 485 denial and not having H1 but I thought a lot and ingored their warning because of the above reason.
ANyways play a safe game and do whatever works better for you. I would appreciate if you post the case details in your signature to know more because people like me are spending some time to share some information.

yes it is worth

yes it is worth, continuing on h1 extension. I would suggest that spend $2000 and stay on h1 instead of using ead at this moment..

if 140 is not approved , ya it makes sense..
Otherwise what is the point?( unless you plan to buy a lc substitute for 10s of ks$ , which again , INS is going to put a hold on soon..)

My case has been transfered to CA center after reply to RFE.
Any pointers as to why it happened and what I need to take care?

Anybody here in EB2 with VSC "FP received date April 12" message or more and I-485/I-140 concurrent filing receipt date of June 15 or more got their I-485 approval ?. If so, please post your details.... thanks for your help.

Hoping for the trend to continue

:rolleyes: Friends congrats to those, who got approvals recently and good luck for guys who are waiting. If the trend, like we saw todays approovals continue, lots of approvls should be on the way to go.
