I have heard many cases approved in Texas like FOM. Basically, 485 was approved right after 140. But they were filed way back to early 2003. Haven't seen any this type case in Vermont. Is this because of FOM?

I know a couple of cases currently filed in VSC between Jan - Jun '03 who got approved (140/485) the FOM way..

Hi All,

Not sure if this is an appropriate question in this forum. Posting here because it is a bit urgent. Appreciate your help.

My spouse (secondary applicant) wants to retain H1B status and is going to Canada for H1B revalidation. If the H1B visa is rejected in Canada can my spouse use AP to enter US on H1B status?

Is there a way we can find out whether a RFE has been issued for a particular application OR we have to depend on our lawyers for the info.?

Please let me know.

Does LUD change with Denial

Guys,
Does LUD change if 140 is denied??

My lawyer have not attached tax returns for 2002, 2003 with case. He did attach the tax return for 2001 ( PR date year). What I should expect Denial or RFE..

In that case - it will be RFE most likely. But do not worry could be approval as well!
 
Question

A question for the guru's
If the company changes it address and/or changes it's company name will it have an effect on the 485 stage,(State) MD remains the same only location change. Thank You In advance

Hi,
I want some info from gurus. As I am in the process of applying 140/485 I like to know do I need to apply AP also? I am having my 7th yr H1B extension stamped upto May,2005 and I am not planning to visit India before Aug/Sep of 2005. Please advise.
Also please let me know what are the things I should be aware of in terms of documents etc. before filing I-140/485 to minimise the chance of getting known RFEs. I saw lot of posting about 'ability to pay' RFE.

Can you give a bit more detail on his/her case:

what line of work?
size of company?
educational background?

My case was filed at around this time. I think mine is pretty simple, also non-sub LC. I work for a big employer and there should be no RFEs on my educational background. I am hoping (as I am sure everyone else is) that my case will be smooth and also will be one of those 'unbelievably fast approval' ones. It would be nice to get a bit more info on your friend's situation.
