Recent court decision for six years calculation.

The American Immigration Lawyers Association (AILA) posted a recent decision of the U.S. Citizenship and Immigration Services (USCIS) Office of Administrative Appeals (AAO) regarding the 6-year time-limit for stay in the U.S. on an H-1B visa:


"...time spent outside the country during the validity period of a [H-1B] petition must be counted towards the alien's maximum stay in the United States, unless that time was interruptive of the alien's employment ... time outside the United States that is considered part of a normal work period, such as weekends and vacations, cannot be considered interruptive of employment, and that the time cannot be reclaimed for purposes of extending the six-year limit."
This issue is still a technical and complex one, but if you feel that it may apply to your situation, we suggest that you contact your immigration attorney.

Wait up to Thursday (14th April) then call FBI at (304)625-5590 and then press option 2 and 3, to check FP status. Make sure you have your A# handy. You will find A# on FP notice, i485 notice. If they tell you that they sent FP results on so and so date to USCIS. Then call USCIS to confirm that they have received FP results.

When you call USCIS don't ask what was the FP results, Just ask "Have they received FP results from FBI or not which were sent on so and so date by FBI?"

Folks.... for those of you who have afternoon appointments, I suggest you go after 11.00AM. I was there last Friday at 8.00AM for a 1.00PM appt and I was'nt let in till 11AM. I was told, they are not letting in afternoon appointments until after that time.

BTW, I also have 2 LUDs on my case.

Can you please answer these questions for me ...

When you call FBI to check on the status of the finger printing. Do you talk to a human being or a computerized recording?

After how long from the Finger printing can you call FBI to know if they sent it back to USCIS?

Notice dates for 140 and 485 filing -------- Dec 2nd 2004

140 Approval date -------- March 30, 2005

485 Approval date -------- April 4, 2005.

I hope these information will be slightly helpful.

EB2, I-485 approval priorities

Folks,

Some of my thoughts on how VSC is prioritizing EB2 I-485 applications for approvals.

1) In order to move the I-485 approval dates beyond March-25, '04 they are approving applicants with ND of April'04
2) As a courtesy, they approving those with early PD (early '02 or even earlier) inspight of their ND being in late '04.

I go in for FP (code 3) on April'13.

You talk to live person and number is not a toll free.

today i got 3rd lud changed and got this mail

look at my signature... if I were you I would start worrying right now :( see, I did my FP on 11/04 and it never got to VSC... so, 4 mo later I got FP2 notice... as a result I lost time - 4 months in total longer than it should...

imho, message should change in 2-4 weeks, if not it's a time bomb...
