EAD LUD change
I see a LUD on my wife's EAD which was approved 4 months back. What could it be? Please share your thoughts.

I have filled my I-140 & I-485 on 01/10/2004. My I-140 took 1 year 2 months to get it approved after RFE. I-485 was not approved yet but i see lots of approvals in Apirl. I have raised a query on 03/28/05 about I-485 and the response was
" Our computer system shows your petition/application is still pending service consideration"
There is LUD on 04/06 & 04/07 on my I-485 as well as my wife I-485. Is this a sign that USCIS started working on my case?. USCIS response letter was dated 04/04 and mailing date was 04/08 on the cover.
I don't think raising query has any help. Gurus anybody is in same situation or anybody has any suggestion please throw some light on my case.

The American Immigration Lawyers Association (AILA) posted a recent decision of the U.S. Citizenship and Immigration Services (USCIS) Office of Administrative Appeals (AAO) regarding the 6-year time-limit for stay in the U.S. on an H-1B visa:
"...time spent outside the country during the validity period of a [H-1B] petition must be counted towards the alien's maximum stay in the United States, unless that time was interruptive of the alien's employment ... time outside the United States that is considered part of a normal work period, such as weekends and vacations, cannot be considered interruptive of employment, and that the time cannot be reclaimed for purposes of extending the six-year limit."
This issue is still a technical and complex one, but if you feel that it may apply to your situation, we suggest that you contact your immigration attorney.

either the labor should have been filed for > 365 days

Not a guru but spoke with my lawyer (my ND is May 04) who said for the MOST part he is seeing approvals based on 485 ND. FP has little bearing on approval if your ND is not current. You filed in June so your turn will come when your ND is current per processing dates. Don't give up! Your case is in the que like most of us!
PS: I read somewhere on the forum that per USCIS when we see cases being approved whose dates are not current (we saw some October '04 approvals) these cases are randomly picked by USCIS to train new officers and hence are processed way quicker.
