Actually i am also in the same boat as you are in. My 140 was denied based on company ability to pay. later i filed 290B and it went to AAO. I changed employer and filed again all application using and substitute labor PD 2001.

application was recived on Dec last week with ND 12 Jan 2005. Since then only LUD on EAD has changed twice and that happened on Jan 20 2005. But since then there is no changes nor there are any new updates. this kind of worries me if my previous application is playing some role in it. dont know gurus please help me with this Q.

Both of you who got 140 denied because of company's inability to pay. I would really appreciate if you could provide me the following details.

Company Industry
Company Size
Salary (Approximate figure)
Were you ever on Bench (If consulting)?

What do you think specifically triggered the inability to pay issue?

The reason I'm asking this is because my wife is planning to switch from H1 to EAD based on my GC application.

My company was an IT consulting with size of 20 odd persons. company showed losses in PD of labor and it got rejected as no profits. no net current assests and my preferred salary was less.

for sub-labor PD is 2001 then u'll be lucky man, you'll get your gc once 140 approves

Mine is also EB3 from India from VSC and very similar to your case with PD Aug 2002. Any idea about Finger Printing ? I mean what's your guess when do you think we should expect finger printing.

Digital Photo location for E-file EAD card

Hi,

My wife and I currently live apart in different states. She's the primary applicant and lives in MA. I live in CA but we all use her address in MA. I want to file EAD application online but according the the website, once e-filed, I will be assigned a nearest ASC center for digital photos. I don't want to fly to MA just for digital photos, is it possible to call the 800# and ask for an ASC appointment in CA? The assumption is I will still e-file using the MA address.

Did anyone use substitute labor where the original applicant of the labor already got the gc based on the the substitute labor being offered by employer?

GC application was based on future employment. Guy never worked for sponsering company and after 140 approval used ac-21 and started working for another company. So sponsering company sent letter to USCIS to withdraw the application and never got the reply back from USCIS. The guy already got the gc now and company is claiming that labor is still available and can be substituted for another employee, since they notified the USCIS and previous employee never worked or intended to work for the sponser company. Is it some kind of glitch in the system?

Gurus, Can you guys analyze this and see if this is possible and riskfree??

As far as i know once E-filed you will get a 1800 number provided in the confirmation receipt page. You have to call that number to schedule a EAD- FP appointment. At that time you can tell them what ASC center you want for yourself and your wife.

OR
You can also E-file separetely one for your and one for your wife with separete addresses.


Just to be 100% safe Call the customer service number tell them your concern. They can help you.

Your wife should not use your EAD and she should try to have a new GC from her H1 company..

Looks like Jan 31st was the day for 140 approvals. Any more recent approvals? Keep em coming VSC.
