First of all, let me thank LC_Virginia, JoyD, Jharkhandi and all other active members of this forum for maintaining this thread, providing useful information and keeping it so lively. I got all the answers I need without ever visiting another site(except USCIS ofcourse). You are all doing great service. Keep it up.
My 140 was approved yesterday. Following are complete details of my case. I would greatly appreciate if you could update the tracker with this info.
Vermont / EB3 / Labor Substitution
Concurrent Filing 140/485/EAD/AP
RD 06/09/04
ND 06/10/04
EAD AD 09/27/04 (After RFE for clear copies of PP & ID)
AP AD 09/30/04 (After RFE for clear copies of PP & ID)
140 AD 10/21/04
No changes on LUD until the date of the approval.
No Finger Print notices yet.
My company is a small company (about 25 employees) based in NJ. They used a former employee's labor certification that shows degree in engineering or equivalent and three years of experience. I have engineering degree (Mechanical) from India and about 9 yrs of experience. I submitted a copy of an educational evaluation that shows that my degree is equal to an engineering degree in US (the same one that I have been using for my H1 filings for the last five years).
Now one thing that is a little odd in my case is that, the status message on 485 applications for both self and spouse changed to the following on the same day my 140 was approved (10/21/04).
"On October 21, 2004, we transferred your I485 Application to Register Permanent Residence or to Adjust Status to our office in CINCINNATI, OH for them to schedule and conduct your interview. Scheduling can take several months. Our office in CINCINNATI, OH will notify you when they schedule your interview or take other action on your case. If you need further information, please call the National Customer Service Center at (800) 375-5283."
Hope that is a good sign.
OK, I know you have a question about their choice of regional office. I am currently working for the above NJ based company for one of their clients in Ohio and provided this OH address while filing the case. Ohio is actually in the jurisdiction of NSC.
