You are one step closer!
well, you can go before your actual FP date. But you may get it done if there is not many people waiting for FP on that day. I am also thinking of doing that way, but i dont know how soon one can go?

joyd - hope you will restrict people from creating any individual posts in the tracker subforum. We also need a cleanup of this section.

The best part is we will have advantage of having both LC_Virginia and zbcx123 in this section.

Well, I'm glad about the tracker being in 1 place.... now I don't have to PM zbcx123 about updating the tracker while I'm gone and vice versa...

First of all, let me thank LC_Virginia, JoyD, Jharkhandi and all other active members of this forum for maintaining this thread, providing useful information and keeping it so lively. I got all the answers I need without ever visiting another site(except USCIS ofcourse). You are all doing great service. Keep it up.

My 140 was approved yesterday. Following are complete details of my case. I would greatly appreciate if you could update the tracker with this info.

Vermont / EB3 / Labor Substitution
Concurrent Filing 140/485/EAD/AP
RD 06/09/04
ND 06/10/04

EAD AD 09/27/04 (After RFE for clear copies of PP & ID)
AP AD 09/30/04 (After RFE for clear copies of PP & ID)
140 AD 10/21/04

No changes on LUD until the date of the approval.
No Finger Print notices yet.

My company is a small company (about 25 employees) based in NJ. They used a former employee's labor certification that shows degree in engineering or equivalent and three years of experience. I have engineering degree (Mechanical) from India and about 9 yrs of experience. I submitted a copy of an educational evaluation that shows that my degree is equal to an engineering degree in US (the same one that I have been using for my H1 filings for the last five years).

Now one thing that is a little odd in my case is that, the status message on 485 applications for both self and spouse changed to the following on the same day my 140 was approved (10/21/04).

"On October 21, 2004, we transferred your I485 Application to Register Permanent Residence or to Adjust Status to our office in CINCINNATI, OH for them to schedule and conduct your interview. Scheduling can take several months. Our office in CINCINNATI, OH will notify you when they schedule your interview or take other action on your case. If you need further information, please call the National Customer Service Center at (800) 375-5283."

Hope that is a good sign. :D

OK, I know you have a question about their choice of regional office. I am currently working for the above NJ based company for one of their clients in Ohio and provided this OH address while filing the case. Ohio is actually in the jurisdiction of NSC.

Any EB2 (Original LC) I-140 Approval lately?

I only saw EB3 got I-140 clear, But what happen to EB2 ? Why they do nothing on EB2?

WOW, congratulations Raghubabu. I140 in 60 days. What EB category was it filed in ... EB3 or EB2?

I Got FP Notice.

FP ND: 09/28/04
Appointment date : 11/16/04 (Newark, NJ)

I-140(EB-3)/I-485 RD 02/05/04,
ND 02/11/04.

My I-140 is still pending. Here is the story. VSC mailed RFE on August 6th 2004. But never received it by attorney/Company. My attorney placed a request to re-issue the RFE after 30 days because they would not take any request before 30 days since the mailed date. So the first request placed on September 10th.
I have not received it yet so I asked my attorney's paralegal to place A second request. That ignorant paralegal told me USCIS would not take second request so I waited few days and requested my company HR department to call the customer service and place the second request.
We (I was also on that call ) placed second request with National Customer Service center yesterday i.e, 10/22/04. According to the Rep I have to wait another 30 days if I don't receive it then place the 3rd request and wait for 30 days and then we could directly speak to an IIO not necessarily from VSC.

Any suggestions/Advise in this regard would be greatly appreciated.

Received FP Notice

We received FP Notice for me and my wife yesterday. ND 10/15/04. Appointment is for 11/16/04 in Boston.

We filed 140/485 concurrently on 2/6/2004. Should have been EB3. Filed under EB2 category by mistake on paralegal's part. No EAD/AP was filed. RD for 140/485s is 2/11/04.

No LUD change since then.

Filed another (corrected) I-140 on 10/15 with a request to replace original I-140. Still waiting for receipt. :rolleyes:

Received FP notice

Hi all,

I have received FP notice today, scheduled for 11/30. My wife received it a couple of weeks earlier scheduled for 11/12. ASC - Alexandria, VA

I would appreciate if you could let me know if Alexandria ASC allows FP to be done before the scheduled date ?

FP notice recieved yesterday by mail. Appointment date: 10/29
for Concurrent case (EB3) filed on 12/6/03. 140 approved in June.
Please update the sheet with FP info.

Nothing personal, but is there any logic as to why a lot of 2004 guys are getting FP notices while the 2003 guys wait for their first FP??? Oh well, this is USCIS, so no logic applies...
 
Understand your feelings joyd. I guess it is due to VSC processing cases in two locations. Good partis that 2003 people who get FP, get approval in couple of weeks. One of my friends did his FP 6 weeks back and got approval in 2 weeks! So hope for the best. And if that still doesn't makes you feel better, think people are waiting for 140 approval who applied in late 2002 and some in mid 2002! These are not just EB2 guys, but lots of them are EB3 folks who see dates getting to mid 2004 for EB3 approvals and their cases are untouched!!
