Hey Bucs - can you give more info about yrou case.. when you got FP notice, when you got it done, etc? You are the first/only one i have heard of who applied in end of Aug and got approved EAD/AP in 15 days!

Spouse FP received on 09/26/2004, completed on 09/30/2004
I am still waiting for my FP

nobody in this forum know the answer to this question. that's just unfortunate.
 
My lawyer recently told me that the pilot program has been stopped as of Sep 30,2004. This means apps filed after sep 30 will no longer be considered under pilot.

Hi ss1123,

Is your lawyer sure that the cases already picked up in the pilot progam but have not been adjudicated will get cleared soon? The attorney of 911 does not seem to think so, as he says it might take upto 1 year for these.

RD for I140/485/765/131 etc etc Oct 14 2004. Received FP on 11/3/2004 for 11/12/2004
 
iEAD denied

This afternoon I went to the San Jose center for an iEAD for me and my spouse. The person said there was a hold on my AP/EAD apps and that meant that they are not allowed to issue EAD and AP. When an RFE was issued on my 140 in July they put a hold on everything else (485, AP and EAD). However on Oct 13th they updated the 140 saying they received the response and processing has resumed. Also my 485 was touched on 10/27 (mass update victim). However the person at the window said in fact the hold on the 485 was removed on 10/27. May be the updates on 10/27 were not some system error or DB error etc.

But I am not sure why they did not remove the hold on the EAD/AP apps (the LUD's did not change since the RFE was issued) . The most positive spin I could give on this one is that they would like to approve the 140/485 if they can and ignore the EAD/AP completely. But again this is like declaring the war in Iraq was over 3 months after the invasion..too optimistic.

Any body else going through a similar situation??

Do you know why the hold on your 485 was removed? Did the person tell you the reason? My 485 was touched on 10/27/04 as well.

As I said all those apps were put on hold when an RFE was issued on my 140 in July. Once they received the response they updated the 140 in mid October and then they updated the 485 (no status change..status still says fingerprints received, processing resumed) i.e. according to the INS person removed the hold. However whoever has the EAD/AP apps did not follow suit.

Folks,

We just got our EB2 labor sub application approved in the pilot program.

I140/I485/EAD/AP RD: Sept 28
I140/I485/EAD/AP ND: Oct 6
1st FP ND: Oct 21
Early FP done: Oct 29
2nd FP ND: Oct 25
I140/I485 AD: Nov 8
EAD/AP AD: ?? (laywer says that we don't need these any more)

that your I-140/I-485 might be approved together, and so the EAD/AP would become irrelevant. (In effect, the RFE woud prove a blessing in disguise)

1. What are the two FP notices people are talking about
2. Can I go to the FP before my scheduled date?
3. Is there a possibility that my case will be picked up in pilot program?

EB 2 , concurrent, large bay area company
140/485 RD- 10/14
140/485 ND- 10/25
FP notice- 11/10

485 case missing on the phone system

I would like to find out if any of you guys who got their approvals had a similar experience. When I call the toll free number to find out my I-485 case status it says it cannot find the case. My I-140 has been missing for a month now (since they updated the online status saying the "RFE response has been received").

Since my 485 has been touched on 10/27/04 no further progress has happened.

I have experienced same problem with my spouse's 485 case. There was RFE and the online status shows they received response to RFE but the phone system doesn't find that case and says there is a temporary problem call back later. May be all RFE cases are separated somehow and not accessible by phone?
 
140/485 approved on 11/15

I received a bunch of emails last night stating that my 140/485 has been approved......what a relief!

I had a knowledge that only EB2 applications are elligible for pilot program, that's what my lawer had told me. But your information shows something surprising ! Can you please clarify ? Are you sure that your case was applied in EB3 ?
