140/485 Approved via pilot proam at CSC

Rajan, can you tell me how long it took to get the receipt? My application was mailed two weeks ago, have not received any RD/ND yet.

the first notice had a fps# and was like a normal computer printout but the 2nd one had 485's wac# and was like a real receipt notice. The 2nd notice had the same FPS# as the first in the lower left corner.

EAD and Advance Parole

Hello All,

I just spoke to my attorney and they he is talking about EAD and advance parole.

Here is my status as of right now.

My H1-B is valid until April 2006. My wife is on H4 and both of us have visa stamping on our passports until April 2006.

Just got the LC approved and about to apply for 140 and 485 concurrently.

My attorney is suggesting that I need to apply for EAD for my wife only and he wants me to stay on H1, so that I can travel overseas with my valid H1 and my wife may work on EAD and she can as well travel on H4.

What should I do? Should I apply for EAD or wait for the whole GC process is completed?

Any suggestions please!

i think you both should apply for EAD , if you want to stay on H1 , that's fine but you can have your EAD as backup for you.
 
What's up with this "Pilot Program"???

Hi Outletvolt1 and others,

I think "Pilot Program" is a overused and very vage term, there are only two important credible guidelines I could find, in regards to 140 - 485 processing:

One memo we all know about (concurrent filing of I140 and I485 memo, 2002).

The only other concrete guideline I found about expediting concurrent filings is the "Ohata memo" 2004.
All service centers have been instructed to implement this memo for indefinite time. According to the info I found on this, your application WILL be processed according to this memo if it meets the requirements, which are explained here http://www.hooyou.com/news/news051304conc.htm. :)

Please add any related memos that you know of, but this general talk about a temporary pilot program sounds like nonsense to me.

Ohata memo

Hi erdfcv,

I do think the Ohata memo is the official guideline on how to adjudicate concurrent filings.
However, this memo does not seem to prescribe specific timelines.
Instead it would be up to the local service centers how to "rapidly adjudicate concurrently filed I-140 and I-485 applications", and I have not found a lot of info on that.

I did hear that the CSC, for instance, tries to adjuducate concurrently filed apps WHICH MEET the Ohata requirements AND are in the E2 category within 90 days.

so this indeed confirmed that everyone who filed after May, as EB2 concurrent, would have fair chances to be in pilot program.

then how come i have not received my fp notice yet? i filed at end of July and only have EAD and AP so far..
 
Well, everyone is treated according to the Ohata guideline. (If you weren't, you would get your I-140 within a couple of months and the I-485 after several years).

About this CSC attempt to process EB2 within 90 days, do you think that this is "a program" in which you are either part of or not; and if you are not, they will take five times as long just because?
Doesn't make much sense to me, I would guess if there were problems / delays due to RFEs or other stuff, they will just put your app on hold and then continue as before once the issue has been resolved.

Should I Call FBI?

I have not receive FP notice. It has been two months since I submitted application.
Someone on another forum recommend call FBI.

My 140/485 applied at NSC on 9th september 04. I got the notice on 19th september 04. Now I received FP notice on 30th September 04 and scheduled on 15th October 04. Does anyone think I should be under pilot program as I got my FP so fast?

Hi newkidhere,

Pilot Program was introduced in June' 04 (or end of May). Cases that were submitted on or after Jun'04 were chosen for Pilot Program. As per my attorney, there is no indication or a hard and fast rule if a case was chosen for Pilot Program. But the only way one can say if a case was chosen for PP is if that case was approved within 90 days from the day the I-140/485 was received. As far as I know there were a very few cases (one of them is my colleague's) that were approved within that time.

Pilot Program was introduced to clear the backlog, guess what?!?, the PP itself is backlogged now. No matter how many bills or Pilot Programs they introduce, the situation won’t get any better unless the authorities show or have the real intention of naturalizing hard working legal immigrants. I don't think USCIS will approve any more GCs until elections are over. Not trying to discourage you, this is the reality and I am in same boat but completed 2 months since I gave my FP (Aug 26th, 04). Hope the info helps you.

CSC has a storage room that is the size of a casino floor. It is filled with shopping carts full of applications. Contractors have been hired to pick applications that qualify for the Pilot program from those shopping carts. So it is anybody's guess on what their chances are for getting picked up in the Pilot program, which by the way, is just another stunt from CSC to put the Senators off their backs for a while.

wow, this is new. if this information is creditable, then i will be totally wordless...matter of fact, i was trying to find connection with CSC - i was just curious how the pilot works...and now i read this.

I know that this is a sensitive issue for all of us. My intention is not to dishearten anybody, but merely to point out the reality. All I can say is let us hope some of us get lucky in getting approvals quickly and also hope that those who get these lucky approvals pray for the rest of us only once but sincerely.

Help For Clarity

I'm from WA state. My attorney is getting ready to file concurrently on my behalf in the very near term. As such, I'm trying to familiarize myself with this process.

I have a couple of questions where I lack clarity.

Given that I'm from WA state and filing concurrently, is this the right link I should be watching and contributing message posts ? Is there a more appropriate message thread I should move to ?

Generally speaking, on an average basis, once filed, and assuming no problems, how long on average is the wait time for I485 approval ?
