but think, the Schedule don't have labor. so they apply I140 and I485 together. So when techies file labor, Schedule A needs to file only I140/I485 concurrently. Means, a nurse who just filed I140 on Dec 31st, '04 might have filed I485 on that...
It doesn't matter because Schedule A doesn't need labor and so they didn't have wait to file I485, after starting the GC process. They can apply I140 and I485 together. That means, any Schedule A applicant(RN/PT), who have just started their process on December 31st, 2004 might have already...
The new bill is meant only for Schedule A. The bill says to recapture only 50% of unused visa numbers and not all unused visas from '01-'04.(unlike last time when it recaptured all numbers from '99-'00). This has a limit of maximum 50000 also.

Talked to Boston DOL today and she said they are processing files of November first week for EB3 Non-RIR. The date they say is the date when they entered the file into their database.

The US Senate has passed a bill by voice vote to recapture 130,000 EB-3 numbers lost from FY 2001-2004 (50% of these numbers would be allocated to Schedule A occupations).This would end the retrogression soon.

Brs2004....your education doesn't matter. The only thing matters is what the job requirement is. I have MS + 8yrs of expereince. But job requirement was only BS + 3 yrs(at least thats what the company/attorney mentioned). So my case became EB3.....so I am destined to wait for long :mad:
Does anyone know whether the date Boston says they are processing is Priority Date or the date they entered our file to the system? If anyone calls Boston again, please confirm this?

Today, I did talk to Boston DOL and the lady said that they are currently processing Non-RIR EB3 files of November. My file was entered into system on 12/14/04 and she said it will be processed in a couple of weeks. She said it will be done in Boston itself.
