Plz explain the new rule effective Feb 1

The purpose of a K3 visa is to allow the spouse of a US citizen to enter the U.S. faster, and wait for the immigrant petition to finish. What this new rule is saying is that if both I-130 and I-129 are approved at the same time, why bother with a nonimmigrant visa? By the time you get your K3...

I485 - fingerprint fee billing notice

Your lawyer may be correct that this is a system error, but I doubt she would guarantee you anything. Did she actually contact USCIS to seek explanation? If not, you might as well make an infopass appointment, bring your FP notice and a printout of the status page, and ask the IO what is going...

    Green Card

Did your father or you receive anything in the mail from the Department of State last year? If you did, that package contains all the instructions on how to proceed to apply for an immigrant visa. There is no guarantee that you will receive the package as soon as PD becomes current, though. Was...

Reg: My EAD and if I can use it or not

Technically no limit, but you don't want to do it too often. Imagine what an adjudication officer would think of your case if you keep changing your supposedly "permanent employment."

What's the number and options to reach an agent (Nebraska)?

If your AP has been significantly delayed, you can make an infopass and ask IO directly. If it is due to USCIS processing delay or error, you may even be able to get one on the spot, for urgent travel needs. Otherwise your best option is to email the service center and wait for their response...

    Sponsoring parents...

Generally speaking, yes, but they should NOT leave the U.S. before GC approval.

FP notice in the last couple of weeks?

A friend of mine has to leave the country in a week, so she did a walk-in with a cancelled appointment notice. And surprisingly, the ASC was almost empty. Maybe USCIS cancelled more than they intended, who knows! You may want to try that too if you don't receive anything; some ASC may be OK...

    Green Card through parents..

Check out the visa bulletin, family-based. Either one (F2 or F4) has a long ways to go. Consult an attorney if you are not sure what is the best option for you.

Weird update on 485 case status. Please help.

Is your PD current? EB or FB? It is indeed a strange notice, especially with the "approval" wording. My guess is that it is about transferring your case to TSC or a local office, but it is just a guess. Hopefully it is better news than that. You should receive something in the mail soon.

    Green Card through parents..

No. You will not get a green card as a derivative based on your parents' IR-5 petition. You have two options: 1. Your sister may sponsor you now, as F4; or 2. Your parents, once granted permanent resident status, may sponsor you, as F2. There are age and marital status requirements in either...

    Writ of Mandamus

Agreed. Filing a law suit is much different than filing an application and a simple error in just following court procedures is all it takes to throw all your efforts/money down the drain. If you do decide to pursue WOM on your own, however, google writ of mandamus and study tons of information...

FP notice in the last couple of weeks?

USCIS over scheduled FP last week, then canceled a bunch of them, and are issuing reschedule notices. So it is sort of a mess. I'd give them a few weeks.

Anyone with a reopened I-485 after MTR?

They usually say 3-6 months when they don't know what is going on. It is like a standard response, so don't sweat on it. Since EB3 is "unavailable" across the board, you have to wait for October VB, which should move past your 2001 PD for ROW. Then give them a couple months for processing and...

    EAD timeline for EB2

If your husband files AOS/EAD along with yours, there shouldn't be much of a gap between your EAD approvals, more often than not. 2-year is a reasonable estimate for EB2-ROW (rest of world), as suggested by the post above.

I140 approved -- Do I need to wait for 485 to become current?

Yes, your PD must be current in order to file I-485. If your LC was filed on 9/11/07, the visa bulletin cut-off date for your category and country of origin must be after that date. VB doesn't move at a steady pace (check here to see a multi-year VB graph), so although it is still going to be...

Immigration Flow Chart - Roadmap to Green Card

Have you ever felt confused by the twists and turns in your immigration journey? What about other routes? This could come in handy. Not likely to help people who are already in the late stage of GC processing, but a flow chart makes it easier to understand the immigration maze ;)...

An immigration road map to Green Card

    EAD renewal and job change.

Unlike H1B, EAD is not employer-specific. So not so much complications. But you might want to read up on AC21, which has a lot to do with your job change and I-485, which obviously affects your EAD.
