I don't know what country u r from. I am from India and I didnot have any records either. My parents had to get a "non availability certificate" from the local registrar office (where I was born) PLUS a notarized letter stating both my parents name and when and where I was born.

My old 140 was approved beore the 485 was closed. Does anyone here know if I should apoply for new 140 with new GC or the old 140 is valid since I haven't heard anything on that from USCIS.

I don't know. never recieved any letter regarding the denial. I would say failure to send RFE. that was the last I heard from them and I know my lawyer must have messed that up.

that is the whole mystery to me. how do I know that my 485 is closed? actually my lawyer said that it has been denied (even though he didnot get any letter, or so he says). MTR was applied within 33 days. Lawyer says my status is still "waiting for adjustment" ...........even with MTR...

My 485 was denied due to RFE not send on time (my lawyer says something different).
anyways, mine was applied on dec. 12th, 2005 (MOTIC)......so as of today it would be more than 90 days. and I haven't heard anything.

USCIS is always looking for reasons "not to do something". they won't consider you if u donot be prompt. this will only delay your process. and in today's time when they r changing every rule..........you never know what will happen tomorrow. so best thing to do is send them RFE ASAP.

actually the FP notice for I-140 was very quick. they hardly gave me day or tow make my travel plans. i recived letter in mail from my lawyer abd also from USCIS on monday and i had FP on that same week friday.
