MOTIC (MTR) after denial of I-485

I filed MTR following the denial of I-485. Now I got this: MOTION TO REOPEN BEFORE THE COMMISSIONER .
It is taking between 30 and 60 days for us to process this kind of case. We will mail you a decision as soon as processing is complete.

What does it mean and who the hell is that commissioner. Is he any better than my stupid officer?

MOTIC status?

Dear Ataku,

What is status on your MOTIC? How long it take to open it?

I am in the same boat and lot of frustration due to I-485 denial.

Could you please tell me why your I-485 was denied. I was thinking to file AC21. Can I go ahead and do it?

What's ur opinion on this one?

oh thanks god i found u guys.
My 485 was denied due to RFE not send on time (my lawyer says something different).
anyways, mine was applied on dec. 12th, 2005 (MOTIC)......so as of today it would be more than 90 days. and I haven't heard anything.
and yes u guys are right. the stupid officers know nothing. I wonder why do they bother to pay the "customer service" people on phone. they don't tell u anything more than what u can read online. they just read it to u.
anyway let us keep each other updated and see what happens.
 
i field in oct 12,2005 in nyc, case moved to california service center and case was opened on jan 17,2006
 
if we apply for new 485 (to be on safe side) will that affect MOTIC?
anybody who has applied for another 485 due to denial of first one?
 
Long Wait for MOTIC

I really wonder if these guys are doing anything, they charge us all the hefty fees and nothing seems to move...
I filed my MOTIC in Dec 05.
Receipt says it takes 30-60 days. No change and progress yet.
When I called them for a status enquiry, they said I have to wait for 6 months.

How can you renew your EAD if the MOTIC does not get approved?
Is it worth applying for a new 485 and EAD?

U know, I m so frustrated with the whole USCIS system. they are so disorganized. My lawyer said that it would be better if we apply for new 485 (for Back up). If MOTIC opens up we can ignore new one or the USCIS will cancel the new one if MOTIC is approved.U can apply new EAD with reference to old 485 (for which MOTIC is applied).
but I have question..............did u guys recieve a denial letter for 485. coz when I check my application status for 485 it still shows open. me or my lawyer haven't recived any notice of denial.
any thoughts??

How do know that your 485 is denied, if neither your attorney nor yourself have received the notice? I guess due to privacy s**t, they do not update online status if there is a denial of 485 application.

They are pretty serious about the 33 day limit for MTR are MOTIC, be careful there..

I AFILED MOTION ON OCT 12,2005, IT WAS APPROVED ON JAN 17.2006.
I-130 WAS APPROVED ON SAME DAY BUT 1-485 IS STILL PENDING.

I ALSO FILED A NEW I-485 AND HAVE GOT INTERVIEW DATE JUNE8, 2006.
I do,y know where is my old i-485

that is the whole mystery to me. how do I know that my 485 is closed? actually my lawyer said that it has been denied (even though he didnot get any letter, or so he says). MTR was applied within 33 days. Lawyer says my status is still "waiting for adjustment" ...........even with MTR.
any of u guys recieved letter of denial?
 
Yes, you should have received letter of denial if it was served, online message although does not change.
 
the last updated date on the motion is for yesterady that is 3/30/2006. does anybody know what that could be for? any info appreciated.

Entering the US while motion is pending?

Hey guys,

I am so glad that I found this forum and hope you can answer a few questions for me!
I filed a motion to reopen my case before the commissioner at the California Service Center after my application to extend my stay on the visitor visa was denied. I received a receipt notice and since August 2nd this petition is pending.
I am curious if I am allowed to reenter the USA while this case is pending or will I get trouble with the officers at the POE? I came back from America last week and desperately need to go back there for 1 or 2 weeks because I have bills to pay and some things to organize. I don't want to book a flight and then be denied at the POE...so what do you think?

Hi,

Did you file MTR? I know it has been long time. I am also in the same boat. they denined my I-485 due to lack of documents sent to them as response to their RFE. When did you file MTR and what happened to that?
