Need Advice on I485 RFE

Folks, i need advice on this peculiar situation. INS issued a RFE on 485 asking some documents and medical report. We didn't had one document so, we submitted all the other documents and sent a letter to INS requesting an extension to submit the missed documents. Now i have got the document and have already sent it to INS. I haven't heard anything from INS uptill now.

Will INS accept the document now after we had missed the due date? What will INS take actions and my options?

USCIS gives you 3 months to response for RFE. I dont think USCIS grants extension in RFE. The documents you sent later may not be counted toward previously issued RFE unless you have any kind of "extension granted letter in RFE" from USCIS and you sent that letter with your documents. But you may get lucky and USCIS will count it toward RFE :D . In my opinion, USCIS probably will issue you "Intent to Deny" notice and will give you 30 days to response. You can then re-submit the documents they asked in previously issued RFE.

You have not explained what kind of RFE you received. It will be better if you could provide details. People in this forum could advice you better if you provide details.

USCIS is always looking for reasons "not to do something". they won't consider you if u donot be prompt. this will only delay your process. and in today's time when they r changing every rule..........you never know what will happen tomorrow. so best thing to do is send them RFE ASAP.

I agree that USCIS will take this course, but you never know. At least they will give one chance to re-submit the document. Actually my lawyer told me, she has handled 2 cases before like this. In one case, they denied the application and in other case they granted the extension for RFE. I think the officer will make his own judgement, whether to accept the document or send denial notice.
Actually the RFE was for documents,we didn't submit while applying I-485 ao we knew they would generate a RFE and we would submit the documents later on.
