DV 2025 AOS (Adjustment of Status) Process Only

Based on the limited information you added to the spreadsheet (you’re still missing quite a bit of pertinent information), it seems to me the delay you’re experiencing could be due to a pending background check clearance considering there’s a reported Fairfax, VA case filed in late June (CN current in July), bio completed in late July, which has already been adjudicated. There’s also a couple of other earlier Fairfax, VA cases that were adjudicated within 4 to 6 weeks of bio completion, so it is possible you could see an update in the next couple of days. The good news is your FO has been waiving the interview based on the reported cases that have been reported.

In terms of your next step, you could initiate a congressional case inquiry now, or wait until the end of this week to see if there’ll be an update before initiating the congressional case inquiry.

So I’m having a difficult time with trying to help you due to inconsistency in the information you’re providing. You previously stated your case was current May, now you’re saying it became current in April.

Anyway if your interview already got waived and the case got approved, you would have seen the pertinent update online. The cells with the missing pertinent information have been highlighted in RED on the spreadsheet.

There’s no fear of visa exhaustion for this FY. Just exercise some patience for now to see how the process goes this time around - your previous background check will most likely be reused which further pushes your case processing timeline forward.
 
Hi Mom, we received the approval letter today. It says that any unexpired EAD document (Form I-766) issued based on your pending I-485 is no longer valid and has been invalidated in their system. You are required to return it by mail. I got my EAD card before applying for AOS, as I was an F1 student. Do I need to send it back or not? Just wanted to double check with you. Thanks a lot.

It really doesn’t matter at this point whether the EAD is F1 based or AOS based, it is effectively invalid once you become a LPR. Once you receive the actual GC, you can decide if you wish to return it or not.

1. So here’s the issue - your data points which you keep providing in your posts is not quite useful to me or your fellow AOSers (both current and future ones). The data points are more valuable in the Timeline spreadsheet which is where you need to get them updated, including the sections already flagged as red on the spreadsheet as earlier stated. There’s no way I can do what I do here for the past 12+ years if everyone was simply listing their data points in forum posts which gets buried over time. That is why we have the spreadsheets as the data repository which can be referenced year after year. So again, help me better help you, and help others by adding your data points to the spreadsheet.

2. I already provided you with information as to what you can do in this post. I suggest you go over it again to review what has been recommended.
 
1. DV based AOS applications go through an expedited process, they do not go through the typically prolonged process for family or employment based AOS applications amongst others.
2. You may try, but I can tell you from experience none of your reasoning meets the expedite criteria. You can’t claim financial loss on the basis of not being able to remain in the US to continue schooling or be eligible to apply for scholarships/fellowships considering you must have gone to great lengths to demonstrate your financial sufficiency in order to obtain your student visa in the first place. And the US embassy in your country being closed does not qualify as a humanitarian basis for an expedite - I’m guessing US embassy in neighboring countries are open to meet that need.
3. Your next best step is to get your bio scheduled and completed for now. Without your bio appointment being completed and you clearing the required background check, your AOS application cannot be adjudicated. So for now, focus on getting your bio notice/appointment. Take a look at the FAQ tab of the AOS process spreadsheet to learn about how to get ahead with the bio appointment scheduling.

You need to send an access request directly from the spreadsheet to enable you add your case details to it. Click the Green View Only dropdown at the top of the spreadsheet, and follow the prompt.
Thanks, Mom! I added my data to the sheet and managed to get my biometrics date through the Emma chat. I was able to reschedule it for tomorrow.

I only have the new appointment notice right now, the pdf from the website, since the original one hasn’t arrived in the mail yet. Is it okay if I just bring the new one, or should reschedule for a later date in order to bring both?

I’m currently waiting for my interview to be scheduled. Will this omission cause any delays or an RFE?

I plan to update my address history on a printed copy of my I-485 and bring it to the interview. I’ll mention it if the officer asks about my address history, or should I proactively bring it up even if they don’t ask?

Shouldn't be a problem. You can update the address when you get called in for your interview.
 
Hi Simon, I think it is possible, BUT it depends on quite a couple of factors such as the FO with jurisdiction over the case, how soon this person can get their medical exam completed which determines how soon they can file - they cannot file without the medical report, that is no longer allowed. If they're able to file no later than the end of this week and the FO is traditionally one of those that is quick with the adjudication process, then I'll say they should give AOS a shot. It will mean filing without the Administrative fee receipt though (since it takes a while to get), that will impact being approved without an interview, or possibly further delay the approval process.

If CP is guaranteed to be expedited, they may be better off going that route.
Hi, checking In for the first time - this is my case, thanks for your help. My current status is that I've completed medical and payment was just delivered to DOS, I haven't done the DS260. Reading the guide, It sounds very risky to submit without payment if it's rejected at lockbox and add further delay waiting for the package to return? My FO is NYC if that matters - it seems like they don't do interview waivers anyway?

So I asked a live agent today about my biometrics being scheduled and they said since I'm asking about it, it hasn't been scheduled and I'll receive a notice when it is scheduled. The way they replied kinda sounded like they didn't actually check if it was scheduled, they just said it hasn't been yet since I didn't receive the notice.

But maybe I'm mistaken.

1. Has anyone got some anecdotes surrounding how the live agents tend to deal with that question?
2. Is the only way to check via a live agent by the way? The chatbot can't tell you?
3. Would it be worth trying to find out via phone call if I think that the live agent is not really checking?

While there has been no report of interview waiver with the NYC FO, it has shown a fairly decent quick turn-around with this FY's DV based AOS cases. While I wouldn't describe AOS package submission without the DV payment receipt as "very risky", yes there is the slight possibility of the package being rejected.

You can always try via phone call, if you're able to get the bot to connect you to a live person. You can also initiate another EMMA chat tomorrow, and request to be connected to a live agent. It is always a hit or miss with the agents, some are could be nice, while some would act like they're being bothered. You just never know which side a coin will land on following a toss up.
 
Hi Everyone , hi mom

On July 17, 2025, USCIS issued a Request for Initial Evidence (RFE) for my Diversity Visa (DV) Adjustment of Status case, requesting the original copy of my birth certificate. I sent the requested document via FedEx on July 22, 2025, and it was delivered to USCIS on July 23, 2025, signed for by “M. William.”

Typically, applicants in similar DV cases who respond to RFEs are notified by USCIS within approximately 10 days that their response has been received. However, it has now been over two weeks since my package was delivered, and my USCIS case status still shows “We have sent a request for initial evidence,” with no update confirming receipt or processing.
The Diversity Visa program operates on a strict fiscal year deadline, and I am deeply concerned that this delay in updating my case could jeopardize the timely adjudication of my application before the September 30, 2025 deadline, potentially resulting in the loss of my visa eligibility despite my prompt compliance.

It is the Houston field office!

What should I do ? I am hopeless
