DV 2025 AOS (Adjustment of Status) Process Only

Update : got my approval notice today, but the class of admission on my notice is DV6, when i looked it up it says 6 stands for ‘spouse of dv visa immigrant’

Im confused what to do? Is that gonna be a problem? Im the main applicant and i applied for my self only and no one else
Where did you look that up? What you found is not correct. Your category as DV6 is correctly listed. DV6 is for primary/principal DV based AOS. Spouse of a DV6 who processed AOS would be DV7, while children likewise would be DV8. DV1,2,3 is for CP.


DV1Principals, new arrivals (CP)
DV6Principals, adjustments (AOS)
DV2Spouses of DV1 or DV6, new arrivals (CP)
DV7Spouses of DV1 or DV6, adjustments (AOS)
DV3Children of DV1 or DV6, new arrivals (CP)
DV8Children of DV1 or DV6, adjustments (AOS)
 
Hey! Is the UK lawsuit going to affect the EU selectees for DV 25? I’m not worried about visa exhaustion before Sep 30, but I’m not sure what else might happen
 
Okay, the IO adjudicating your AOS application from your FO called you. Unfortunately it sounds like you’ll have to make the payment for the rest of your family before he will adjudicate your application. You already did everything you needed to do correctly, I don’t see any other solution outside of making the payment.

A couple of past selectees in similar situation such as yours have reported a similar experience in the past, and they ended up making the payment as requested. Yes the payment is non-refundable and there’s no guarantee the embassy will accept the payment receipt from your family members (in lieu of the actual payment) when the time comes for them to attend their FTJ interview (if they make it to that stage).

Does your annual income meet the applicable poverty guideline for a family of 5? If it does, and you can demonstrate that, then you may not a sponsor for your family.

p.s. add your case data to the Timeline spreadsheet, you indicated you were going to do so a while back.

Yes, we were comfortably in a place where they're gonna under-issue by thousands, but then the lawsuit happened. DOS added 44 British cases and that doomed DV25 (not even processed, nor scheduled yet btw). EU visas will now surely run out by September 1. Brits and their fertility rate... it's just crazy!

Bring this to the attention of your IO when you go in for your interview. In the interim, you can reach out to the embassy with jurisdiction over the FTJ process to find out if they will be able to interview your derivatives on or before EOB on Sept. 30th. Ask them what they’ll need from you to make this happen.

p.s. do add your case details to the 2025 Timeline spreadsheet to provide us with better insight into your case.

For those of us unfamiliar with it, what is the short summary of the lawsuit?
It became clear that they screwed up the draw by making UK born people eligible, but forgetting to select anyone from the UK in DV2025 or 26. They also selected winners from Cuba in DV2026, who were supposed to be ineligible.

Obviously no one was gonna sue the government for a 1 in 100 chance of being selected. I realized I was uniquely positioned to file a lawsuit that would benefit everyone and I had standing via my daughter because she had entered DV2025. So I filed a lawsuit in June represented by Curtis Morrison (Paul V Trump). I got some of the costs crowdfunded through a gofundme. They had until August 15th to respond, and yesterday they made the announcement that admitted their mistake. They have released 44 new EU cases under 23000, and those cases will be fasttracked through with a bit of luck (and oversight via the lawsuit). This will also fix DV2026.

My number became current in August (EU21XXX), and I was given an interview date of September 4 which is rather late taking into account I completed biometrics on July 3rd. Would trying to get in touch with my Field Office to get an earlier interview date necessary? Could it harm the process and my already scheduled interview date?

Mom - quick question. One of these UK new cases is in the USA and wondering whether to file AOS or do CP.

I'm pretty sure they are going to expedite the CP cases because of the lawsuit (and the judge will want reports etc) but that would be harder with an AOS case (different agency that we haven't directly sued). So do you think there is time these days to start AOS now and get through by Sept 30th?

Hi Simon, I think it is possible, BUT it depends on quite a couple of factors such as the FO with jurisdiction over the case, how soon this person can get their medical exam completed which determines how soon they can file - they cannot file without the medical report, that is no longer allowed. If they're able to file no later than the end of this week and the FO is traditionally one of those that is quick with the adjudication process, then I'll say they should give AOS a shot. It will mean filing without the Administrative fee receipt though (since it takes a while to get), that will impact being approved without an interview, or possibly further delay the approval process.

If CP is guaranteed to be expedited, they may be better off going that route.
