The officer has the discretion to ask for the tax documents but usually they do not do that unless there is an issue about your tax payment history. An exception is if you have a marriage-based application--in that case tax returns are mandatory.
They can delay the process but without more specific evidence of fraud I do not see how they can deny N-400. The burden of proving fraud is upon them.

As far I can tell, the Senate bill contains the provision you asked about (it is a 600+ page document). It is now up to the House and the Senate to reach an agreement (hopefully with White House prodding). Colleagues in DC say that they are seeing mixed signals from the House--so who knows.
