I received an RFE today on my EB3 I-140 application. I do not know the details yet about the RFE. My guess is it might be about Ability to Pay, as I have the necessary educational qualifications, but you never know what these people are capable of asking.
I have just been approved for my I-140 application. My employer is a small business and they do not want to get the lawyers involved in the whole process and therefore I have been guiding them in the labor and 140 application process. Now that my 140 has been approved, I need to know the process...

Just wanted to let you know that my I-140 (EB2) has been approved.
I have another I-140 (EB3) pending. The RD on EB3 pending date is Aug 14 and the ND on the approved EB2 petition is Sept 4. Filing is regular and service center is NSC.

The EB dates have jumped quite a bit.
For India EB2 the date has moved to April 2004 from Jan 2003.
And EB3 has moved from Aug 2002 to June 2003.
these dates are quite a jump from the previous months. Hope they keep...

Is anyone still here trying to find out if they case exists. My lawyer contacted BEC thru email, and to date, we have received no response. Kinda getting worried as my PD is Aug 2001, from KS state.
you can. you have to contact the uscis and ask to cancel the application.
but if the transfer was approved, you cannot cancel it, but you can still work for your old company as long as the original H1 is valid.
Receipt Date is the date your application was received at the USCIS center.
Notice Date is the date your application receipt was generated.
For the cap, it is the Receipt Date that matters, so you are safe.
My application was filed on May 22nd, and receipted on May 26th. My application has been approved on Sept 28. Most of the applications that were filed between May 16 and May 25 have been approved. There are around 10% of applications that were filed before May 25 are pending.
As per my knowledge, if your OPT expires, you cannot work. But you are still in legal status as your H1 has been applied for. You can start working once your H1 is approved. You need not get the application in hand to start work.
