DV 2026 All Selectees (Consular Processing - CP)

Hello guys, another question here.

So basically this person that I said that won the lottery, is my partner, and we’ve basically said beforehand to wait till they get the visa so we can marry later on but we’ve realized that it’s gonna take years probably for me to finally live with them in the US, their case is currently on ‘current’, but still haven’t received any confirmation for interview yet.
So I wanted to know you guys thoughts, can we still get married? Or it’s already impossible to do so?, if we can, In the DS260 they put they were single, would there be a problem if our relationship have lasted 4 years? Or any particularities that we should consider if we marry now?
I would like to know any details, thank you!

You can marry now, your partner can update their ds260 details to married and and add you as a derivative - assuming that the ds260 is still available to unlock and add - it might not be if the number is current already. Expect the marriage to get scrutinized, so when you interview make sure to take plenty of evidence that your relationship is genuine.

The KCC said this when we asked for any update:”If you need to make changes to your DS-260 you should contact the consular section where you will be interviewed, or bring the information about your changes to your interview appointment. Because your case is ready to be scheduled, KCC can no longer unlock your application.”
And thank you! Two things, would this be a good option? Because we are a same-sex couple so we don’t know if getting married and the possibilities of being denied because of the relationship could be a thing. Also I’m disabled in my country (I have autism that it’s considered an social disability here, but I’m high functioning) so I don’t know if that could be a reason to be denied the visa, the idea was that maybe they could get more chances of winning it since it’s only them and no one else participating.

Another thing, if we get married, and as the KCC said the application is locked, what should I do here? Still add the new participant to my partner’s application and bring my application form to the consular of my country, with all the extra information of mine?

As long as the marriage is legal in the country it is performed (and is not polygamous) it is recognized as valid for immigration purposes. However, you may carefully want to consider where in the US you want to settle as some states are significantly less friendly to lgbtq than others.
Autism is not an issue. Communicable diseases, and mental illnesses or addiction that may lead to harm of self or others are the main medical disqualifications.

As KCC said, you need to contact the consulate first to see if they will let you can unlock the DS260 and add you on. You can’t just arrive at the embassy for an interview without being formally added to the case first, and that requires the DS260 being unlocked.

Hello there.
I am selectee on DV2026 (AS26K) and live in Japan. I submitted my DS260 in July. I know my CN is too high and risky.
Separate from DV, I have been applying for EB-3 since last year, and my I-140 was approved last month. The next step is to submit my DS-260.

I have a question.
Will filing DV and EB-3 DS-260 at the same time cause any problems with each process?

Thank you.

Having multiple applications in the system should not be a problem.

Thank you so much for your answer!
I appreciate it.
Just one last thing, I’ve heard in other forums that when you ask the consulte to reopen your DS-260 they completely reschedule your date of interview which could cause that we wouldn’t get a visa in time, is this true?

The consulate where the interview will be said that when my partner’s case is at the consulate and the date of interview is sent, just then, they could re-open the DS-260.
Should I still contact both the consulate and KCC when we are civilly married?

But I am confused about this, because the KCC specifically said:” If you need to make changes to your DS-260 you should contact the consular section where you will be interviewed, or bring the information about your changes to your interview appointment. Because your case is ready to be scheduled, KCC can no longer unlock your application.“

But the consulate of our country said:” Thank you for your message. As soon as you receive the interview date and your case arrives at the consulate we can reopen the DS-260 form.”

So I’m not sure who email to unlock my partner’s DS260

As KCC told you, it is too late for them to unlock, so you can only unlock by emailing the consulate AFTER you have been scheduled.

No, possibly a particular consulate did that but it is not blanket true

KCC has nothing more to do with your case, just communicate with the consulate.
