OIG to Launch Investigation of DV-2012; Wall Street Journal Article
Posted on June 6, 2011 by admin
You may recall that on May 25, 2011, we requested that the Office of Inspector General at the Department of State launch an investigation into the invalidation of the DV-2012 results. We have now received a reply from the General Counsel within the Office of Inspector General at the Department of State:

Mr. White:

Deputy Inspector General Geisel asked me to reply to your letter to him, dated May 25, 2011. Thank you for your letter and your interest in this matter. The Department has asked the Office of Inspector General to review the Diversity Visa Lottery matter and we have agreed to do so.

Sincerely,

Erich O. Hart

While no additional details were provided, one can surmise that this is an encouraging sign. Nevertheless, this should in no way detract from our resolve to proceed with our lawsuit; in fact, the timing of the OIG letter – 24 hours after my post on the need for litigation – appears more than coincidental.

We should of course hope for the best – a quick, prompt settlement that will reinstate the selection of the 22,000 winners – but prepare for the worst.

Miriam Jordan at the Wall Street Journal was kind enough to write an article on the invalidation travesty and OIG’s initiation of the investigation. Here is the link:

We will be posting an FAQ about the litigation within 24 hours.

You know what.. I think the initial winners who started all this, don't give a damn if it's cancelled or not.. They got nothing to lose, and even if the programme gets shut down, they're not losing anything.. They could care less about other ~15 million people . I think it was the right decision to void the results, it really showed the true colors of certain people. I hope karma gets them all..

This is going to give unneeded and unwanted attention to the dv lotto to only cause it to be abolished soon.
Immigration is a hot button issue in the States and this adds to the fuel.

I was kind of sympathetic to the people who won now I'm thinking all the attention this is causing will hurt all of us in the future.

FYI

This case (below) was a 'dramatic' one and the ruling was 'unprecedented'! (i.e. issue the DV winner a visa although the FY is way past)

However, I think the ruling was just relief to proceed to trial. I think it never went to trial and thus the case never set a precedent derogatory to the US govt.'s stand.
That shows how 'difficult' it takes for one to take the govt. to task.
But sure, it is not 'impossible', 'cos thousands has done it in various ways, successfully.

The success of this year's 'illegitimate winners' ' legal action is yet to be seen, and no doubt it is gonna be an uphill task. But again, nothing is impossible and ppl sure can give it a try!!.

The courts MAY issue a favorable but just a symbolic ruling like the following, which the govt. may not implement at all !!

If the 'illegitimate winners' exhort their way into re-instatement, i can't wait for the 13 million or so that weren't selected via a FAIR and RANDOM process assured to them by US Law to start their court proceedings; at least they have fairness and justice on their side!

Sorry ajk,
The May 1st winners don't want to cheat everyone else out of another "fair and random" win. They all seem to agree to hold another draw - they would just like to be considered to be able to join the queque. How is that unfair???

and in reply to USAnDream, I think this has actually shown the true colours of many of the other 15million! Why are they so heartless to take away the original winners? Give us a chance at the back of the line, we may miss out, we may not - no skin off your nose!

Agreed!!! Allow the initial 22,000 winners, honor the US govt written letter, then re-draw addition 78,000. with this, everyone will be happy. I wish they didn't post the results in the first place, should have dotted all the "i's", cross all the "t's" before posting. This is their fault.

"Original winners" what original winners....a mistake was made and they were not the winners in the way the lottery should have been acted.

All others were cheated out of a chance and the lottery knew that the only right thing to do is to start over.

Btw...what about a lawsuit of the rest of the people cheated out...ever thought about that?

In most lawsuits or recalls the companies way their gains and losses...and whatever is the greater loss or win is what they will go with.

Do you think a car manufacturer that has an issue with their car model and one person gets injured is going to recall that car even though they know it is a malfunction? Nope! When 10 people have similar issues they start to act since 1 lawsuit is cheaper than a recall...but when it gets to the point of too many the recall sounds much better.

I wonder what will be your reaction if you were one of the 22000 winners !!?

What do you mean back of the line?

I have stated that from the beginning .....anybody would feel bad, but than again you have to use common sense and be realistic.

Winning or thinking you have received a lot of money which later is proven to be an error doesn't give you the right to keep it.

Many people had large amounts on their bank statements and later found out it was a bank error....they don't get to keep 1%, 10% or 100% they will have to return it and receive 0%. There are even stories of people who started to spend it and had to pay back....

It was invalid....either keep whining or live in reality....
