my case is aos family based still pending i left the country on valid advance parole coz of urgent dad was sick now its exp on 09/2010 while im out side the country what i can do hel p me please ?
 
If your AP document has expired, you are in a spot of bother. What is the basis of your AOS and what was the status you had before applying for AOS?

If and when the I-130 is approved, your spouse must file I-824 to transfer the case to a consulate ... unless you can obtain a dual-intent visa like H1B or L1 to reenter the US.

I hope you didn't overstay the B1/B2 visa for 180 days before filing for AOS.

If your AP expired in September 2010, that means it was issued in September 2009, and your AOS was filed before September 2009. It's unusual to have a marriage-based AOS pending for so long. Is your case based on marriage to a US citizen, or marriage to a permanent resident? Have you been interviewed?
 
i did file the oas in 04/2009 and interview in 10/2009 recivied intend to deny in 02/2010 nothing new untill 12/2010 when these two guys came and they where informed that i left for emergency they tlk to every one when my wife try to tlk to them no one answer her and i try to reach them they said they send the paper to the uscis and i didnt over stay ?
she is us citizen

You're screwed. They had already issued an intent to deny and you travelled abroad (away from your "wife") then overstayed advance parole which was actually good for a whole year! A home visit revealed that you were not living together---a very bad situation.
 
yes i did had a advance parole good untill 09/2010 and we did respond to the intend in the time frame they gave us , please guys i need help my lawyer she just telling me wait wait she dont want to do any thing from the start

You did not say if the I-130 was approved or denied.

What's the rest of the story?

yes all my papers where approved thats how i fly in the first time and i have i-94 expire in April 2011 that i get when i had to leave in the first time now i dont know what to do since the only answer is wait
and if the answer from the uscis was not good this mean im not going to be allowed to enter the state never again or what?
 
You are very confused. Ask your spouse if the I-130 is approved. Then re-read post #4, and you'll be able to reenter the US after interviewing for an immigrant visa at a US consulate (you will have to redo the fingerprinting and medical, in accordance with instructions from the consulate).
 
u made so confused now when we file my paper a lawyer did it and yes she did send and i was approved now just explain to me what to do now
since i did tell u every thing about the intend to deny and the two people who came and the expire AP that i have , please
 
The I-824 will not help your adjustment of status case which is now dead, but it will enable you to immigrate via the consulate, if your I-130 is approved.

Have your spouse find another lawyer.
 
we didnt try to find other one and what u mean by dead?
if i was deny what this put me in going back to state ? or find other way to apply since im registered nurse who passed the nclex exam and licenced
in two states
 
and i know im asking alot but i swear this thing is killing me i heard about thing call lottery they said i can apply to it if i win i can get my papers and just go back to my wife and just not trouble coz of this application which i was killed with and answers please
