Please help... i need some information urgently!

Hi, i was wondering if any one could provide me with some information about the form I-130 which my mom, my brother and i, applied for through my uncle, who is a legal U.S. resident. We applied for the I-130 on April 20, 2001, and we just got a letter sent to us saying that our case is "received and pending" on December 18, 2008. The processing time for it right now is February 25, 2001, (which i really don't understand what this date means) for the "U.S. citizen filing for a brother or sister" classification. How long do you think it'll take for us to get another notice from USCIS telling us when they've made their decision? and the process after that to actually getting legal residency in the U.S.?

That's the priority date for an immigration visa to be available. Looks like your priority day is current, you should be hearing from USCIS in two to three month.

Residents cannot apply for their siblings.

and the process after that to actually getting legal residency in the U.S.?
are you in the US legally? how old are you and your brother? was the petition ever approved?
 
well we are here legally on a visitors visa.... since we where kind of forced out of our country when i was very young... because my father was very abusive... and we had to leave everything behind in order to get a new beginning, i am 17 and my brother 22, and i want to know how to apply for an F-1 visa because i've grown very accustom here and my whole life is here, and if i where to go back, i would be throwing all of my hard work away...
 
if all of you (your mom, you, and your brother) were here on b1/b2 but now with an expired visa. You will not able to adjust your status because your uncle is sponsoring your family.
 
Having read that he got out of his country when very young and his saying that he is on B visa, I think he is overstaying. However, I am under impression that his case is 245(i).
 
They meet the priority date requirements. Hopefully they also meet the physical presence requirement.

Yes. THey seem to clear the deadline of I-130 filing(4/30/01). The Q is whether they entered the US before 12/21/00.

But still not sure with limited info from OP.
 
If he is qualify under §245(i), I suggest he should seek an immigration lawyer immediately to work this out.
 
I just received this email from NVC. People with experience please what does it mean and please, when should I be expecting a notification of their action? Thanks

It's just a general notice that they accepted your applicationi under §245(i) and is reviewing your case. §245(i) route is not an easy route and sometimes taking forever.
