I have a question...I'm applying for asylum in a week..My job autorization expired in september 2007,but since then I've been working illegally. So,may it result in refuse for asylum if I'll be asked the question about work and I say- I worked so as to survive here?

Although my knowledge on asylum is very limited compared to others in here, based on my knowledge, I can assure you that your status doesn't make difference in the asylum decision, provided that you haven't committed any crime that is. Any immigrant can file for status once they're inside the borders, it doesn't matter whether they're here legally or illegally.

1. Most likely the asylum officer will not ask you that kind of question. However, if for some odd reason the officer do ask you, tell the truth... remember, you dont want to be caught lying and then the officer will think you are also lying in your asylum application.

2. NOTHING WILL HAPPEN TO YOU, and the fact that you have worked illegaly WILL NOT AFFECT the asylum decision. Asylees are "forgiven" if they have worked illegaly, enter the country without inspection (illegaly), or use fake documents to enter the country. Asylees and Refugees are the only ones that have this "benefit".

3. I have seen cases that they have worked illegaly and their asylum were approved. Some others were referred to a IJ, and some others were denied. So the approval or denial IT IS NOT BASED on wether you work illegaly or not.

Good Luck, and dont worry too much.

I worked illegally for years. It was not an issue during my asylum application. If you are applying for asylum after more than one year of coming to the U.S., you will need to address the issue.

It will not affect the asylum decision itself.

If your asylum case is not successful then (as a result of your working without permission) the time during which your case is pending will count as unlawfully present for purposes of the 3/10 year bars.

THANKFUL, I SENT YOU TWO PRIVATE MESSAGES BUT DIDNT GET REPLY
THANKS

Feel very happy for you, Buddie!:p

So you didn't put the illegal work history on the form and left it blank?

Could you reveal where you got approved?

Thanks!
