I just wonder when i485 people get the visa number? (when submit 485? after namecheck is clear?)thanks.

I went to infopass today, and they told me I need to wait for the visa number. they told me the visa number is given after everything is pass in i485 (such as FBI namecheck.) so I may get the card in July 2008 since I just get namecheck clear this year... is this correct? I really got confuse. thank you! (they gave me wrong information before in the counter so I don't really trust what they said.)

PS. my PD is Oct 2001 and I am from Taiwan so it is in the "All Charge-ability Areas Except Those Listed " "EB3"

bobyang3,

Why has it taken so long for your case to make any progress? were you stuck in the namecheck or background checks? What is the wrong information Infopass provided you before?

I don't know why. I think it is the namecheck issue because they told my namecheck is clear in Sep 5 2007... however, thing I feel weird, most of my case get green card in no more than 45 days after namecheck is clear. I call the customer service, they said my case has been tranfer from TX to the local office. I don't know why they need to transfer my case to local office. GC must issue from the local office? won't it take longer since it needs to wait for i485 process date?

Transfer to local can be a lot of reasons or no reason at all (random QC). Either way, that's bad news for you, because most likely your local office will call you in for an interview, approve your case, and then send it back to the District office for card production, which means DELAYs.

If they case is approved at an interview (and yes, there will most likely be one) then an I-551 stamp can be obtained on the spot. If the plastic card takes a few weeks or months to arrive, no big deal.

I agree that waiting for the physical card to arrive is no big deal. But base on my own experience, he'll have to wait at least several months before the local office takes up his case and schedule an appointment for him which will be at least another couple of months away from the date they send out the appointment letter... Anyway, transfer to local means delays. He could've had his approval the day they transferred his case had this not happened... The only benefit of having one's case transferred to local is that, if something went wrong, it would be easier to fight since it's "local".

Good luck!

Thank you!

My i485 dated as Dec 2004. the current local office i485 process is 6 months. if my case is transfered from the service center to the local office, do I need to wait for another 6 months for them to look at my case or I will cut the line since I was way before the current date?

I plan to go for a vacations about 1 month. what's if I miss the letter or the interview? anyway to make up or I can give them the notice ahead?

thank you!

Based on my understanding, the processing time you mentioned (6 months) applies to only 485 cases filed at the local office, not those that are transferred from Service Centers. There are two seperate queues and they only publish the processing time for locally filed cases. There is no good way to know when they'll process your case.

And if you missed your interview, your 485 would be denied based on your no-show and you would not be allowed to reenter the US. You can file MTR, of course, but that's a big hassle. So you'd better postpone your travel plan, or go talk to your local IO and they may give you some information.
