Hi All,
General question, my case got transferred to Newark, NJ local office for N400 (now my online status is interview and testing).. but I have not recieved any interview letter.
I just wanted to check is it possible that I am stuck for Name check? The reason I ask is that I was stuck in Name check for green card. My wife also got stuck for name check before..

or when the case is transferred to local office, does it mean that name check step is completed?

Any thoughts/insights would help..
Thanks a lot

An second level IO at USCIS hotline put it best: "NORMALLY We do not schedule interview
until the name check is done". So normaly it means your FBI name check is done if yoru file is transferred to LO

Transfer is a good sign. You can contact the FBI about the fingerprint check but as you may know, the FP check is only part of the background check, so, good luck.

Standard procedure is to complete all the background checks before scheduling the interview. However, a small percentage of people still have the name check pending when the interview occurs.

So, it means that even if u got stuck in name check for the green card u may not get stuck for N-400, right?

I was stuck in name check for a year for my green card!

You might still get stuck in name check for the N-400; they might delay your interview for a long time because of it.

However, once you have the N-400 interview, you won't be stuck very long. Either they would have completed it before the interview, or if it is still pending they have to complete it in 120 days after the interview or you will gain the right to file a 1447(b) lawsuit.

How does it really work? teh background check is doen by FBI etc even beyond USCIS control.
If FBI can not finish it in 120 days after interview, what will USCIS do? If they let teh applicant take oath but what if the backgroudn check compldteed after oath show teh applicant is not eligible?

Can USCIS deny the application by saying that "we have to amke a decision in 120 days but
since backgroudn check is not completed yet by FBI so our decision has to be a denal"?

Don't be ridiculous. An incomplete background check wouldn't result in a denial. It would result in a delay. USCIS has the authority to choose additional background checks as needed, so when push comes to shove in form of a lawsuit after the 120 day limit, USCIS can still determine what alternative background is acceptable to the naturalization process.
