This question is regarding to understand when I be eligible for applying N400 application.
(Either 5 years or 3 years)

Details:

I got Employment based (EB2) green card on Feb,1,2009.
My spouse got the U.S citizenship on Jul,15,2009.
I am married to my spouse since last four years.

Will I be eligible for applying for U.S Citizenship after 3 years (i.e. 2 year 9 months) counting from the date my spouse got citizenship.?

Assumption:

I will be following rest of the rules mentioned in N400 application (i.e. Live with citizen spouse for three and more year, Complete physical attendance requirements,Intact the LPR Status,Good moral character etc)

You'll be eligible to apply 3 years after your spouse received US citizenship (Jul 15 2012) . The 90 day grace period only applies to continuous residence, not marriage to US citizen.
