I am married to a USC and we are getting ready to file I-130, I-485 and the rest. I have been married before and my ex husband came to the US on F-2. We have a daughter together (USC). We have been divorced for almost 2 years now but we have joint custody. I was wondering what will happen to the father of my daughter when I file to adjust my status. I am concerned because he is afterall the father of my child and they spend quite some time together. As far as I know he has not done anything about his status which expired when we got divorced.
I guess my questions, put simply, are: What will happen to my husband when I file? Will the fact that I file have any negative impacts on his ability of staying here and visiting with our daughter?
