What happens with F-2 when F-1 files I-485

Hi guys,

I am married to a USC and we are getting ready to file I-130, I-485 and the rest. I have been married before and my ex husband came to the US on F-2. We have a daughter together (USC). We have been divorced for almost 2 years now but we have joint custody. I was wondering what will happen to the father of my daughter when I file to adjust my status. I am concerned because he is afterall the father of my child and they spend quite some time together. As far as I know he has not done anything about his status which expired when we got divorced.

I guess my questions, put simply, are: What will happen to my husband when I file? Will the fact that I file have any negative impacts on his ability of staying here and visiting with our daughter?

you meant your ex-husband right? He is already out of status when you 2 divorced and faces a 10 year ban upon re-entering the US unless he marries an US citizen.
 
My scenario was that when I file, INS will see that my ex is out of status and they will start the removal proceedings right away. I know he is my ex and everything , but I also want our child to be able to see her dad. And if he finds somebody to marry I wish him all the best.


Another question: will I have any problems because I did not report at school that I got divorced? I just did not want him to have any more problems on top of those created with my divorce.

lol Please don't be worried about him. YOu are the one filiing not hime, its your file the'll look into not his. The only time his name might come up is, "haven you ever been married and to whom , and when and where was the divorce?, and that is just a straight forward answer like you documented on your i- 485 application.

I applaud your compassion for your ex-husband. Very commendable. However, legally speaking, he has been on his own (immigration wise) the moment the divorce was finalised. Both of you have no bearing on each other's immigration status now.
