Waiting Asylum decision

I am concern with new President and his plan to change everything, Do yo think Adjusting of status under asylum can be slow?, the new rule that we can apply before one year can be change immediately?

From what I know there is no way that you can get your green card before 1year after your asylum is approved. If there is anyone who get thier green card before 1 year after asylum approval, please prove me wrong bc I heard some folks saying so. The point is you can submit your application anytime after you get your approval but decision can only be made after you lived 356 days with in the US starting from the day your asylum is granted that they can approve your green card application based on A05. This rule is under INA. Idt Trump caould change it alone without the congresses involvement.

My case was filed in Sep 2024 so should I terminate my F1 visa or should keep it like that?
And what could be the timeline or waiting time would be to get a court date?

Are you still attending the school ? even if not, I suggest keeping your status as F1 while your asylum is pending.

I have a quick question. My asylum case was approved in oct 2024 and based on the new policy that USCIS implemented, an asylee can apply for green card immediatly after their granted asylum. However, USCIS adjudicate their green card application after one year of being physically present in the US. I hear some attorneys are saying that it is better to wait 6 month from the day of your asylum grant before applying for adjustement of status. Now that Trump won the election, he may change the rule from the day one and it has been one month from the day my asylum was granted. So should I apply for green card now or wait til 6 month??

He can change this, either way your application will be processed under Trump administration, I have the exactly timeline and I was planning to submit everything in February, now I am confused

That’s a big mistake by USCIS and he needs to call them and send them the card back or later will be accused of having a GC that he didn’t have the right to get it! The law is clear that an asylee can’t have a GC until 1 year have passed of residency after getting approval so tell him to not be happy and call USCIS to send them the card!

Can you please give us the date of issue of the GC? Usually it is backdated exactly 1 year ago. Maybe now USCIS approve GC earlier than 1 year but date of issue is NOT before asylum granted? This is second case with approval of GC for the short period of time, so maybe change of rule, not a mistake

I contacted her a few days ago to see if we can change plans and file earlier to avoid any change in rules, she got mad at me. now, I am also so confused. Please see her reply below if can be of any help to anyone.
"Let me explain further: in 2018, when Trump was the president, he issued a USCIS policy granting officers discretion to deny Green Cards or Visas without first issuing a Request for Evidence or Notice of Intent to Deny may be reinstated, thereby permitting denials for innocent mistakes or missing documents. Prior to Trump, I indeed filed many green card applications without medicals so I can buy more time. However, different times necessitate different measures. You were approved on 8/30, so my cautious diary is to file after 6 months, which means we start the process in mid-February. Of course, we can file sooner, but I cannot guarantee that the 2018 policy (that was later cancelled) will not be-reissued again in the middle of your pending application. In all events, it is your money. My job is to advise"

I Will wait at least 6 months that would be around April, if he decides to change something is enough time either way the green card will process under his new rules.

I like your lawyer lol She/ He knows how to set the appropriate tone to the email. It seems a serious matter and remember Lawyers are so frustrated right now so I don't blame them.

Not bad to clarify things with USCIS before it is too late to do so.

I am eagerly waiting for that information too. He hasn’t received the physical card yet. Will give an update once he receive the card.

I understand your point.
Since he is closer to the 1 year mark, by the time we communicate and send the green card back to USCIS, he would have passed his 1 year mark. Also it’s USCIS error. They have all his information on when his case was granted, they shouldn’t have approved it in the first place.
Since everyone is trying hard to get a green card well before trump comes to office, it would prove costly to send the green card back. I will update everyone on what is the back date on the card once the physical card arrives.

I understand brother but pin my post!! when he applies for the citizenship he will have a huge problem as it happend to someone i know and they said he got the GC before he deserved it and they delayed his citizenship for another 4 years!! he is free to do what he wants but when USCIS makes a mistake they won't forgive the applicant because it was their mistake! enough said but to be happy for getting the GC 2-3 earlier before it't legit time doesn't worth the headache he will get when he goes for his N-400!
 
My Friend, Came through boarder and got NTA...
BUT..
The case was not docketed online to EOIR Court..
He applied and sent I-589 to USCIS (Not to court bcs court was showing : No case found)
SO applied for I-765 after 150 days still..he got denied and sent this attached notice.
Can anyone help me to understand this ?
