Wage determination and timeline

maybe they change only the date but the ad is ok....don't worry to much. We hope on April 9 to fill up the Perm. I heard that the small company can get the audit much faster than big company. What do you know about that? Today we got the reciepts from our lawer for the ads and the copy for the prevailing wage. Guess what??!!! I noticed that she got the prevailing wage from DOL on January 5. We asked her on January 17 and she found out than that she got the PW. I don't understand why people are so lazy :confused: :eek: ......

When I last spoke with the paralegal assigned to our case she said they are going to start advertising next week. It was November 20th. The ad appeared Jan 10th. That is some week. Just ask, and ask, they are not in a hurry.

I am really disappointed about the ad. I really hope that we did not loose 27 days of advertising.

I am in the same situation you have been in 2-3 month ago. I was wondering if you had any further information as to why your PW has taken long? did you do anything to speed it up?

Hi all. I have two questions,

1- Company's lawyer informed me today that they requested wage determination from SWA about a month ago and haven't heard back yet. Does anyone have any explanation for this? Is it the holidays or something went wrong do you think?

2- I've read most of the forum but still don't have a complete picture of the whole process. Can someone who knows kindly summarize the PERM process step by step, with approximate time estimates? I just would like to know what steps lie ahead (not just 90 days posting etc. but all steps, such as this SWA thing).

Hi Sina, sorry I couldn't check back here in a while. It turns out that the delay in PW determination was standard- I heard it from several other people too. There's nothing you can do but wait, I guess the workload is heavy in busy states, so hang in there. We heard back from them in about 40 days I believe. You can start preparing other documents in the meanwhile (letter from previous employers), job description for ad etc if your HR and lawyer are willing, so as to save a little time. Good luck and keep us posted!

Johnny- thanx for the update on cost and fees, we hope to start worrying about the next stage soon.

happy you are back. Our things are not going anywhere. The recruitment period ended on April 25th, we approved part of the application on May 5th (full of mistakes, you can't imagine). Have not heard ANYTHING since then. The HR says that the lawyer is "WORKING" and will email if the application is filed. No email whatsoever since then. I am starting to get the impression it is not going to happen....
 
Unsure hi, it's good to be back. Sorry to hear of your difficutlies but don't lose hope at all- these things take a lot of preparation and trial and error but once they get going, they go, so as always- patience. We're (=they're) filing this week, but as our application is going to atlanta, that probably means another frustrating waiting period, so if yours is going to chicago, you may even be done faster than we'll hopefully be. Don't lose hope, keep us posted please. Take care.

We are waiting for the results. We filed on May, 9. Unsure, you are going with M+ years maybe this is the reason for the delay.

On trackitt.com there are two applications filed after ours and already approved. I am working on preparing the next stage - translations of marriage certificates, and obtaining the immunization history, so I can do the medical ASAP. I can't wait this to be over ....

- evaluation
- translations for eveything
- 16 passport pix

What means "the immunization history"?
 
with "immunization history" I mean a form from my doctor what immunizations I had and when. I have most of what is required for the medical and I don't want to be poked for things I already have. I took me about 2 weeks to get them, as they were not in a hurry. I am not either :D

My lawyer said:
For the I-140: employer's latest tax return or financial statement
your 2006 tax return with W-2
your year to date earnings paystubs
employer letter from prior employers (only if you have, not
absolutely necessary)
your diploma, and translation, and academic evaluation (we
already have)

For the I-485: birth certificate (for both) & translation
marriage certificate & translation
valid passport & I-94

You do not need to send me originals, so long as good copies are provided.


Presently, 2 passport size photos each, taken within 30 days of application.

Locate approved doctors by the civil surgeons locator link in the www.uscis.gov. Do not do it yet. Reports are only good for one year. Rules about submitting the medical report with the applications have changed over the years, I recommend waiting until such time the application for adjustment is almost ready before doing the examination.

So, I want to be ready to take the exam the day after she submits the 140. Also, I have dealt with our medical facility about immunization forms and it takes soome time. If you have them on hand you are all set. I don't want to wait two - three more weeks. I want all filed before july (to avoid the new fees). Also, this part of the application I can control!

I am agree with you but we are at Atlanta. God knows when our Perm will be certified - can be from 1 month to 4 or 5 months:eek:. I hope that the employer will be nice with the I 140 form. I have a friend from California and he spent almost 2 weeks for medical exam. Also his Perm was certified in 3 weekes. He started the green card on September, 2006. He filed I 485 just last week.:p I hope with all my heart to file before July, 16. I don't have the medical exam yet but everything else is ok.:p

I found the list with the doctors for my area and the cost for immigration medical exam is starting from 150$ to 350$. I going next week to do the medical exam with 150$. It's risky but I hope that my Perm to be certified..SOON!!!!

good for you. I am not going to actually take the exam until the PERM is approved :). It is 3 of us, x200 each, so it will be $600. I don't want to spend all these money for nothing ...
 
Hey unsure, hey johnny, things seem to be moving forward a little bit with all of us, right?!? great! the lawyers filed PERM beginning of may for us but they're not giving us an account or password to follow up. i don't understand it but my husband is with a huge company and they told us this has been standard procedure with everyone, they'll hopefully let us know when there's an approval (or if there are any problems). we're at atlanta as well, keeping our fingers crosses. as my hubby is eb-3, the i485 seems like a million years away, even if we'll pass the perm and i140, but hope never dies, right. do take care, awaiting all the great news.
